WHERFAS, H. C. ~cBride, General Contractor on the Refuse Burner, Project Wash.
48-260 (N), Bremerton, Washington, has completed all work under his contract in accord-
ance with the approved plans and contract documents
AND WHEREAS, the date specified for completion under the contract occurred on
December 3, 1943, but the work was not completed until December 8, 1945, an excess of
three (3) days.
WHEREAS, the over-r~m in the specified contract completion time is due entirely
to unforeseen construction difficulties requiring more time, described in the Contractor
letter of request for extension of time dated December 8, 1945, and
WHEREAS, liquidated d~nages were specifle~ in the C~ntrsct,
~EREAS, no damage of any nature whatsoever o~urred by reason of failure of the
contractor to comolete his work ~ithin the time specified:
NOW, THEREFORE, BE IT RESOLVED
(t) That no liquidated damsges be asserteU by reason of H. C. ~icBride's failure
to complete the work within the time specified, and
(2) That the resolution of unqualified, unconditional waiving of 8amages be
transmitte~ to the Regional Engineer of the Federal Works Agency for his
approval.
PASSED by the City Council of the City of Bremerton, Washington, signed by the
