WHEREAS, the Western Gas Company of Washington has offered to sell the following
described real property to the City of Bremerton:
Lots 4 and 5; the East half of Lot 3, and the East half
of the South 40 feet of Lot 2, Supplemental Plat of
Bayview Garden Tracts, and Lots 22 and 23, Joseph Daly's
Garden Tracts, Kitsap County, Washington,
ALSO a perpetual easement granting to the City of
Bremerton the right to the use of property described as
follows, for the purpose of maintaining thereon a dump
for the disposal of refuse and garbage:
That part of Lot 1, and the North 39.99 feet of Lot 2,
Supplemental Plat of Bayview Garden Tracts, along the
Easterly boundary thereof, which is embraced by the
natural water course or ravine along said Easterly portion
of said lots, Kitsap County, Washington,
for the total purchase price of $8,000,00; subject however to city assessments, and
subject to an unpaid balance of $360.00 payable in monthly installments on the heating
plant in the five-room dwelling house on the said property, and
WPIEREAS, the City Commission has adopted on first reading an emergency ordinance
authorizing the issuance of emergency warrants for payment of said sum and has decided
to buy the said real property and to pay the sum of $8,000.00 therefor,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BREMERTON,
that the Western Gas Company of Washington, a corporation, be and it is hereby notified
that the City of Bremerton accepts its proposal contained in its letter of April lA,
1941.
BE IT FURTHER RESOLVED that the City Attorney be and he is hereby instructed to
prepare a contract providing for the sale and purchase of the said real property for
said sum, which shall provide that the seller shall furnish title insurance to the City
of Bremerton, and shall embody other provisions contained in said letter of the Western
Gas Company of Washington, a corporation, and that the Mayor and City Clerk be and they
are hereby authorized and directed to sign such contract on behalf of the City of
Bremerton.
BE IT FURriER RESOLVED, that the City Attorney be and he is hereby instructed to
make such arrangements as he shall deem necessary for the protection of the City of
Bremerton in connection with an escrow agreement under the terms of which the purchase
price shall be placed in escrow at the Bremerton Trust and Savings Bank, in the City
of Bremerton, Washington, or in some other suitable financial or title insurance
institution.
PASSED by the City Commission of the City of Bremerton, signed by the Mayor, and
attested by the City Clerk in authentication of such passage, this 7th day of May, 1941.
