RESOLUTION NO. 353
WHEREAS, M. Moschetto, General Contractor on Park Avenue Sewer, Project Wash.
45-179, Bremerton, Washington, has completed all work under his contract in accord-
ance with the approved plans and contract documents, and
WHEREAS, the date specified for the completion under the contract and any
extension of time heretofore granted did occur on August 12th, 1943 but the work
was not completed luatll January 19th, 1944 an excess of 160 days, and
WHEREAS, the over-run in the specified contract time is due entirely to un-
foreseen construction difficulties requiring more time described in the Contractor's
letter, to the City Engineer, of request for time extension dated March 4th, 1944,
and
WHERE6S, liquidated damages were specified in the Contract, and
WttEHEAS, no damage of any nature whatsoever~ occured by reason of failure of
the Contractor to complete his week within the time specified:
NOW, T~MEFORE, BE IT RESOLVED; (1) That no liquidated damages be ass~rted by
reason of M. Moschetto's failure to complete the wDrk within the time specified,
and (2) That the reso]ut~on of unqusl~tied, unconditional waiving of damages be
tranamftt~ed to the Regional ~gineer of the Federal Works Agency for his approval.
PASSED by the City Council of the City of Bremerton, Washington, signed by
the Mayor, and attested by the City Clerk in authentication of such passage this
15th day of March, 1944.
