WHEREAS, the City of Bremerton entered into a contrect on the llth day of
December, 1940, with the Marine Drive Water District, a municipal corporation, under
the terms of which certain monies collected from water users outside the city limits,
comprising twenty per cent of the gross revenues collected by the City of Bremerton,
have been deposited in a trust account, and
WHEREAS, due to questions raised by Examiners of the Division of Municipal
Corporations, said monies have not been paid over to the County Treasurer of Kitsap
County as the Treasurer for said ~arine Drive Water District, and
WHEREAS, the Marine Drive Water District instituted legal action in the Superior
Court against the City of Bremerton, seeking a Judgment requiring the City of
Bremerton to pay over said monies, and the Attorney General of the State of Washington
has ruled that the contract hereinabove referred to is in all respects valid snd legal
and that said trust monies should be paid over in conformance with the terms of the
contract, and said legal action has been settled and dismissed, new therefore,
BE IT RESOLVED by the City Council of the City of Bremerton that the City
Treasurer be an,d he is hereby d~.rected to pay to the County Treasurer of Kitsap County
as the Treasurer of the Marine Drive Water District, all trust monies accumulated in
said fund up to the 1st day of January, 19~, and thereafter pay trust monies
received quarterly to the County Treasurer as Treasurer of the Marine Drive Water
District, in conformance with the terms of said contract.
BE IT FURTHER RESOD~ED that under the terms of s similar contract, the City
Treasurer of the City of Bremerton has an accumulated trust fund comprising twenty
per cent of the gross revenues rec,ive~ from water users in the Phinney Bay Water
District, that the circumstances recit..e~ in this resolution are equally applicable
to the PhiRney Bay Water District and the City Treasurer is hereby directed to pay
to the County Treasurer o£ Kitsap County as the Treasurer of the Phinney Bay Water
District, all trust monies accumulated in said fund up to the 1st day of January, 1945,
and thereafter pay trust monies received quarterly to the County Treasure~ as
Treasurer of the ?hinney Bay Water D~strict, in conformance with the terms of said
contract.
PASSED by the City Council of the City of Bremerton, signed by t~e Mayor, and
attested by the City Clerk in authentication thereof this llth day of JGnuary, 1945.
