BE IT RESOLYED BY 'iT]E CITY COT~[CIL OF T}]E CITY OF BRE~RTON:
Section i, That the public interest requires the following improvements
to be made.
Section 2~ That it is the intention of the City Council of 'the City of
Brm,.,~rton to order th~ improvement of Nipsic Avenue between E. Ninths
Street and E. ~leventh Street by clearing~ grubbing~ grading for~ and
construction of, ~ ft, concrete sidewalks, concrete curbs and gutters,
together with thc doing of any and all other work in connection therewith
as may be necessary to ma-~e such improvements a complete job, all in
accordance with plans and specifications to b~ placed on file in the office
of the City Clerk in the City of Bremorton, reference to which is hereby
made for further particulars~
Section 3~ The City Engineer of the City of Brem~rton is hereby directed to
submit to the City Council at or prior to the date fixed for h~aring pro-
tests to said Luprow~ments, the estimated cost and expense of such an im-
pro~,.~m.~nt, and a stat~mont of th~ proportionate amount thereof, which should
b~ born~ by the proporty within the proposed assessment district, and a
statoment of the aggr~ogat~: assessed valuation of the real estate, exclusive
of improvements, within such proposed ~istrict, according to th~ valuation
last plac.~m upon it for th~ purl~'ose of a general taxation, together with a
diagrmn or plan showing th~.r~on the lots, tracts, and parcels of land and
other property which will b~ specially benefited thereby and the estimated
amount of' th~ cost and oxp~nse of such improvomonts to bo born~ by such lot,
tract or parcel of ½knd or oth~r property.
Section ~, That there shall be assessed against that portion of the
proporty lying between the termin~ of said improvement and extel,ding back
frmn the marginal li~e of ~ach of said streets and alloys so improved to
tho middle of the block on each side thereof, which distance shall be at
lo,st ninety feet from said street margin, in the mode prescribed by
Section lj, Chapter ~8 of the S~ssion Laws of the State of ,'~ashington for
1911, and S~.ction 2, Chapter 165 for the Session Laws of 1915, of s~id
State, tb.e cosz of said improv,mmnts oxcept such as may be borne by any de-
partment of a&ministration of the Unit~d $tat~s Govormnent and txcept such
as m~y be born,~ by any Department or ~dministration of the State of N,~shing-
ton or th~ ~Jnit~d Stat~a Gov=rr=m~nt for r~liof or other purposes.
Section 5- The City Cleft. be and h~ is hereby directed to give notim~ of
tr.o date of such hearing so each owner or reputed owner of any and all lots,
trivets, or p~rcels of l~nd, or other prop,~rty, specially benefi~cd by 'the
improwem~nt, by mailing to tho owner or reputed owner of the property as
sho~a-~ on the t.,z rolls of thc County ?re,:~s~ror, at the a~drsss shown thsr~on,
a :io'sice setting forth the nature of the proposed improvements, the total
cs~i~t~d cost and thc estim,~ted b~nof~ts to tho particular lot, tD~ct, or
p~'.~c,~!, '.nd th% d'~te of th.~ h~aring b~foro the City Com~nission at least 15
Cqfs b~foro the dat~ fix~d h<~rein for such he~ring,

Section 6. That Wednesday the 4th day of De~.
1946 , at 1~:00 o'clock a.m. of s~id day be and the same is hereby fixed
as th~' date of he,ring protest against said improvements by any persons
intcr,~sted therein; and the City Clerk be and is hereby authorized and
dir~c"~od to publish a copy of this resolution in the official newspaper of
said city for at least two successive issues, the first issue sh:~ll be at
le~s't 15 d~.ys prior to the date herein fixed for said h~aring, ,~nd said
pub!ic~,tion, together with the m~iling of the c~rds hereinabove provided to
the owners or reputed owners of the lots ~nd parcels of land included in
such improvement as hereinbefore set forth, sh~ll be due ~nd legal notice to
'.~ll concerned in said proposed improvements.
