1~ER~AS, a request has been received from M. MOSCHETTO,
Contractor for Capitol Hill Sewer District, State Development-
L.I.D. No. 229, File No. 26-1-52, for a change order of exten-
sion of time for completion of Contract,
~,~AS, the date specified for .completion under the Contract
occurs on August 31, 19~?, but the work will not be completed un-
til November 29, 19~?, an excess of ninety (90) cslendar days,
WNE ~REAS, the over-run in the specified Contract completion time
is due entirely to the Contractor's inability to obtain materials~
together with unforseen diffi6u~ties in tunnel excavation,
~J~EAS, liquidated damages were specified in the Contract,
and
WHEREAS, no damages of any nature whatsoever will occur by
reason of failure of the Contractor to complete his work within the
time specified,
NOW, T~ERE~, BE IT RF~SOLVED:
(1) That no liquidated damages be asserted by reason of
M. MOSCHETTO's failure to complete his work within the time spec-
ified, and
(2) That this resolution of unqualified, uncon~it{onal waiv-
ing of damages be approved by the City Council of the City of
Bremerton, Washington.
PASSED by the City Council, signed by the ~ayor and attested
by the City Clerk in authentication of such passage this 2?th day
of August, 19h?.
