Napoli Company for an extension of time within which to complete
its contract with the City of Bremerton for construction of sewer
outfalls and pressure mains to commence at t he end of the agreed
contract time limit and
WHEREAS, the overrun in the specified contract completion
time is due to the contractor's inability to obtain the pipe
necessary to complete the project and
WHEREAS, liquidated damages are specified by said contract
but it appears that no damage of any nature will occur by reason
of the failure of the contractor to complete its work within the
time specified; now, therefore,
BE IT RESOLVED:
1. That Nalaspina & Napoli Company be granted an extension
of l~O days within which to complete the work required by its
contract.
~. That no liquidated damages be claimed by the City b~ reason
of the failure of the contractor to complete its work within the
time specified.
3. That a copy of this resolution be sent to the contractor
and the surety on the contractor's perform~uce bond.
Passed by the City Council of the City of Bremerton, signed
by the Mayor and attested by the City Clerk in authenticat~n of
such passage this 17th day of August, 19~9.
