Company en'tered into a contract I'or the erection, construction ~d
completion oi' the Jest Sremerton Sewage Treatmen~ Yt~and P~p
Station~ and
~'~HER~S, taere has been suomitted to the City Co~c~l of the
City of Bremerton 0h~ge Order ~o. ~ on said co~'~tract, and
~HER~S~ Change Order No. 3 will necessarily extend ~e comple-
tion d~te cz' sa~m project for a period of thirty (30) days ~d will
cost an additional ~3~418.90, plus sales t~ to be based on the s~
of ~3,247.00, and
~R~S, liquidated damages are specie'led by saim contract~
but i~ appears ~ha~ no m~aa~e o~' ~y natur~ will occ~ by reason of
the failur~ of the con-tractor to complete its work within the time
specified by t~e contract ~,.nm that c~aages are waived by '~he con-
tractor;
N0~, fI~FORE, BE IE RESOLVED:
1. i'~at ~all-A~water Company, contractors~ be granted ~ ex-
tension of thirty (30) days within which to complete the work re-
quired by its contract.
2. ~at no liquidave~ da~ages be claimed by the City by reason
oI' the failure oi' the contractor to complete within the time speci-
fied by the original contract and the contractor w~iv~s any claim for
dmuages by reason oi' such ci~an~=e order.
3. ~hat a copy o~' this resolution 0e forwarded to the Hall-
at~ater Company aha to the surety on the contractor's perfo~ce
bond,
PASS~, unanimously by the City Council oi' the City of Bremerton~
signed by the l~ayor and attested by the City Clerk in authentication
