WHEREAS~ heretofore the City of Bremerton entered into a
certain contract with Lent's for certain work upon. Snyder Avenue
and other sewer district work under L. I. D. 2~2 and
WHEREAS, the date for completion in the original contract
was set as of February 23, 1951, but that due to certain delays
beyond the control of the contractor~ due to the inability to ob-
tain proper materials and due also to inclement ~ather, it will
be impossible to complete the contemplated work by the date speci-
fied in the contract, and
W~REAS, no liquidated damages were specified in the contract
as between the City of Bremerton and the contractor and no damages
of any nature will occur by reason of the failure of the contrac-
tor to complete its work on the date specified, and said contractor
has ~de a request in writing for an extension of 120 days or until
the 23rd day of June, 1951.
NOW, THE~F~E, BE IT RESOLED by the City of Bremerton
t~t the time for completion of the work contemplated under the
contract for L. I. D. 2&2 be and hereby is changed to and extended
until the 23rd day of June, 1951, and
~ IT FURTHER RESOLED THAT no liquidated da~ges or damages
of any nature shall be asserted by the City of Bremerton by reason
of t he failure to complete the contract on the date specified and
BE IT FURTHER ~.~SOLV~D THAT a copy of this resolution be
fo~arded by the City Clerk to Lent's and to the surety on the
contractor's perforraance ~nd.
P~SED by the City Council of the City of Bremerton, signed
by the l~ayor and attested by the City Clerk in authentication of
such passage this 21st day of February, 1951.
