~qE~, heretofore the City of Bremerton entered into a Contract ~with
Warberg Brothers Painting Company of Bremerton, ~ashington, for the doing of
certain work upon the ~unicipal Repair Garage and Paint Shop, with an original
date of completion set for December 30, 1954, which date was by Contract No.
399, signed by the Nayor and City Clerk and Warberg Brothers Painting Company
on November 10, 1954, which original date of completion was extended to April
9, 1955, by Resolution No. 887 dated January 5, 1955, which extended date of
completion was again extended to July 9, 1955, by Resolution No. 895, dated
April 27, 1955, and
WH.~S, it was not possible to cosplete the work by the 9th day of July,
1955, and the delay in completion was caused by the Contractor's inability to
obtain the workers to complete the necessary preparatory work called for under
Contract No. 399, and
¥ ~r~51REAS, the work cannot reasonably be completed until the 7th day of
September, 1955,
NOW Tk~REFORE, BE IT RESOLVED by the City Council of the City of Bremerton
that the time of completion for the work contemplated under Contract No. 399,
with the Warberg Brothers Painting Company for Painting the Nunicipal Repair
Garage and Paint Shop be and the same is hereby changed and ex~ ended to and in-
cluding the 7th day of September, 1955,
BE IT FURTPW~R RESOLVED that no liquidated damages or damages of any nature
shall be asserted by the City of Bremerton by reason of the Contractor's failure
to complete the work by the date specified therein or extended by said Contract
No. 399 or Resolution No. 887 or Resolution No. 895.
BE IT FURTHER RESOLVED that a copy of this tiesolution be forwarded to
Warberg Brothers Painting Company and its Surety on its Performance Bond, by the
City Clerk.
