HomeMy WebLinkAbout895 WHEREAS, heretofore the City of Bremerton entered into a Contract with
Warberg Brothers Painting Company of Bremerton, Washington, for the doing of
certain work upon the Municipal Repair Garage and Paint Shop with an original
date of completion set for December 30, 1954, which date was by Contract No.
399, signed by the Mayor and City Clerk and Warberg Brothers Painting Company
on November lO~ 1954, which original date of completion was extended to April
9, 1955, by Resolution No. 887 dated January 5, 1955, signed by the ~ayor and
City Clerk on January ~, 1955, and
W~EAS, it is not possible to complete said work by the 9th day of April,
19~5, and the delay in completion was caused by inclement weather, and
WHERFAS, no liquidated damages are specified in the Contract between the
City of Bremerton and Warberg Brothers Painting Company, and no damages of any
nature will occur by reason of failure of the Contractor to complete said work
by April 9, 1955, and
WHEHEAS, the work cannot reasonably be completed until the 9th day of July,
1955,
NC~¥ THEREFORE, BE IT RESOLVe) by the City Council of the City of Bremerton
that the time of completion for the work contemplated under Contract with the
Warberg Brothers Painting Company for Painting the Municipal Repair Garage and
Paint Sho¥ be and the same is hereby changed and extended to and including the
9th day of July, 1955.
BE IT FURTHER RESOLVED that no liquidated damages or damages of any nature
shall be asserted by the City of Bremerton by reason bf the Contractor's failure
to complete the work by the date specified therein or extended by said Contract
No. 399 or Resolution No. 887.
BE IT FURTP~ RESOLVED that a copy of this resolution be forwarded by the
City Clerk to l~arberg Brothers Painting Company and to the surety on its
performance bond.
PASSED by the City Council of the City of Bremerton, signed by the Mayor
and attested by the City Clerk in authentication of such passage this
