HomeMy WebLinkAbout887 WHEREAS, heretofore the City of Bremerton entered into a Contract with
Warberg Brothers Paint~ Compan~ of Bremerton, Washington, for the doing of certain
work upon the Mmnicipal Repair Garage and Paint Shop with a n original date of completion
set for December 30th~ 1954, which date was by Contract No. 3~9, signed by the Mayor
mad City Clerk and Warberg Brothers Painting Compauy on November 10, 1954, and
Whereas, it is not possible to complet~ said work by the 30th day of December,
1954, and the delay in cmmpletion was caused by inclement weather, and
WHEREAS, no liquidated damages are specified in ~he Contract between the
City of Bremerton and Warberg Brothers Painting Company, and no damages of any nature
will occur by reason of failure of the Contractor to complete said work by December
30, 1954, and
WHEREAS, the work eanuot reasonably be completed until the 9th day of
April, 1955,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Bremerton
that. he time of comp1 etlon for the work contemplated under the Contract with Uarberg
Brothers Painting Cometary for Painting the Municipal Repair Garage and Paint Shop be
and hereby is changed to and extended to and including the ?th day of April, 1955.
BE IT FURTHER RESOLVED that no liquidated damages or ~amages of any nature
shall be asserteA by the City of Bremerton by reason of the Contractor's failure to
complete the wore by the date specified therein or extended by said Contract No. 399.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded by the
City Clerk to ~arberg Brothers Painting Compam~ and to the surety on its performance
bond.
PASSED by the City Council of the City of Bremerton, signed by the Mayor
and attested by the City Clerk in authentication of such passage this ~ day
