B.~ ZT P_~SOLV~D DY T~-!'~ CITY COUNCIL OF THE CITY OF BR~L~i~RTON:
Section 1. That the public interest requires the following Lmprovements
to be made.
Section 2. That it is the intention of the City Council of the City of
Bremerton to order the h~aprovement of Herren Avenue between Dibb Street and
E 3~rd Street a~d E 33rd Street between Solie Avenue and Herren Avenue by the
construction of sanitaKy se¥~ers, together ~th the doing of any and all other
work in co~nection there~.~-th as may be necessary to make such improvement a
complete job. Allin accordance ~ith the plans &nd specifications to be placed
on file in the office of the City Clerk in the City of Bre~erton, reference to
which is hereby made for further particulars.
Section 3. That the City Engineer of the °ity of Bremerton is hereby
directed to submit to the City Council at or prior to the date fixed for hearing~
protests to said improvements, the estimated cost and expense of such improvement
and a statement of the proportionate ~mount thereof, which should be borne by the
property ~ithin the proi?osed assessment district~ and a statement of the aggregate
assessed valuation of the real estate~ exclusive of im'orovements~ within such
district, according to the valuation last placed upon it for the purpose of a
general taxation~ together with a diagram or plan sho~ving thereon the lots~ tracts,
and parcels of land or other property which ~ill be specially benefited thereby,
~d the est~aated amou~t of the cost and expense of such improvements to be borne
by such lot, tracts or parcel of land or other property.
Seci~ion ~. That the cost and exp~ense of said improvement to be borne by said
improvement district and exclusive of any portion borne by either the State of
~Vashington or other governmental agency, shall be assessed against said property
included in said improvement district in proportion to said area, except wherein
the special benefits conferred upon the property are not fairly reflected by the
use of ~he teEnini and zone method~ the assessment shall be made against the
property of the district in accor~a~ce with the special benefits it will derive
from the improvement without regard to the zone ~d termini method, and in
accordance v~ith-the provisions of Section 936~ of Remington's ~ievised Statutes
of the State of ~iaShington, the remainder of said cost of the improvement to be
paid for by arrangement, if any, with either the State of 'Jashington or other
governmental agency.
Section ~. That the City Clerk be and he is hereby directed to give notice
of the date of such hearing to each owner or reputed o%~er of any and all lots,
tracts or parcels of land or other property specially benefited by the improvement
by mailing to the ~ner or reputed owner of the property as shown on the tax rolls
of the Co~uaty Treasurer, at the address shown thereon, a notice setting forth the
nature of the proposed Lmprovements, the total estimated cost and the estimated
benefits to the particular lot, tract, or parcel, and the date of the hearing before
the City Council at least l~ days before the date fixed herein for such hearing.
Section 6. That Wednesday the l?th day of September, 19~2, at ll:OO o'clock
A.~.~., D.S.T., of said day be and the same is hereby fixed as the date of hearing
protest against said improvements by any persons interested therein; s~ad the
City Clerk be and is hereby authorized and directed to publish a copy of tkis
resolution in the official newspaper or said City for at least two successive
issues, the first issue to be at least l~ days prior to the date herein fixed
for said hearing, andm~ said publication, together v~ith the mailing of the
notices hereinabove provided to the owners or reputed o~mers of the lots and
parcels of land included in such improvement as hereinabove set forth, shall
be due and legal notice to all concerned in said proposed improvements.
Passed, by the City Council of the City of Bremerton, signed by the L~ayor
