WHEREAS, heretofore and on or about the 2nd day of January,
1934, ROY P. DOW~EP~ and wife, executed to Kitsap County, Washington,
a municipal corporation, a certain right-of-way deed over property
hereinafter described for purposes of the establishment of a county
road, ~nd
WHEREAS, said description on said deed was in error and no
county road was ever established over the hereinafter described
property and no portion of said property was ever used by Kitsap
~ounty for roadway purposes and the county road existing adjacent
to said property is removed from the her~ei~after described property
and is not located upon any part thereof, and
WHEREAS, by annexation to the City of Bremerton, the
hereinafter described property together with other property has
subsequently become a part of the City of Bremerton and the right-
of-way deed and property covered thereby has become the property
of the City of Bremerton and the said City does not now maintain
a road, street or way on any portion of the hereinafter described
property but has located a street or way near and adjacent to such
described property, which is presently used as a public street, and
the right-of-way deed creates a cloud upon the title of the present
owners of said described property,
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Bremerton that the property described as: The East 93.50
feet of the West 11~3.50 feet of the following described tract;
commencing at a point 350 feet West of the Northwest oorner of
Section 15, Township 24 North, Range i East, W.M. and running
thence South 66 fee~ thence West 313.50 feet; thence North 66
feet; thence East 313.50 feet to the point of beginning,
is hereby declared not to be necessary for any public way or street
in the City of Bremerton, and
BE IT FURTHER RESOLVED that the Mayor and City Clerk of the
City of Bremerton are hereby authorized and directed to make, execute
and deliver to GLADYS A. WATKINS, present owner of adjoining prop-
erty, and of which the above description is a part, conveying any
interest which the City of B~emerton might have in said property
by reason of the right-of-way deed to Kitsap County, Washington,
which is recorded in Volume 191 of Deeds, page 56~, records of
Kitsap County, Washington.
PASSED unanimously by the City Council- of the City of
Bremerton this ~ o~day of January, 1952; signed by the Mayor
and attested by the Clerk in authentication of such passage.
