Section 2. T~t it is ~he intention of the City Co. oil of the
City oz' Bremerton to order the ~provement of North ~fayette Avenue
between Sixth Street and Ninth Street by the construction of concrete
curbs and gutters, and concrete side~s fo~ (4) feet ~de c~ the
west side only, together ~th the doing o1' any and all other work in
connect, ion there~th as ~y be necessa~ to ~ke such improvement a
complete job~ all in accordance with the plans and specifications to
be placed on I'ile in the office of the City Clerk of %he City of
Bremerton reference to which is h~reby ~de for f~ther ~rticulars.
Section 3. That the City ~gineer of the City of Bremerton is
hereby directed to su~t to the City Co~cil at or prior to the date
fixed for hearing protests to s~id ~provements, the esti~ted cost and
expense of such improvement, ~d a statement of the proportional ~oUnt
thereof, w~ch should be bo~e by the prope~y within the proposed
assessment district, and a statement of the aggregate assessed valuation
o~3 the real estate, exclusive of improvements, ~thin such proposed
district according to the valuation last p~ced upon it for the purpose
of a seneral ta~tion~ together ~th a diagr~ or plan sho~ng thereon
o.~or ~ope~y ~ich shall be
the lots, tracts, and parcels of l~d and ~'~
specia ~ly benefited thereby ~d the esti~ted ~o~t of the cost and
expense of ~ch improveuents to ~e bo~e by such lot, tract or parcel cz~
land or other prope~y.
Section ~. That toe cost and expense of said improvement to be
borne by said improvement dist~ct and exclusive of ~y portion bo~e by
either the State of Washington or other gove~ental agency, s~ll be
assessed against said ~operty included ~ said improvement district in
proportion to said area, except wherein the special benefits conferred
upon the property are not fairly reflected by %he use of *,he te~ini and

zone metbod~ the asaessme~t shall be made agairst the property of the
district in accordance wit?~ +.he specmal benefits it will derive from the
improvement without regarm to the zone and termini method and in accordance
with the provisions o£ Section 9365 of Remington,s Revised statutes of the
Sta~e ~£ Washington, the remainder of sad. d cost to b~ paid for by arrange-
ment ii' any, v,~th either thc Sts, te of Washington or other aovernmental
agency.
Sectzon 5. That the City Clerk be and he is hereby diz'ected to give
notice of ~he date of such hearing to each owner or reputed owner of any and
all lots, tracts, or parcels of land or other p~.operty specially benefited by
the improvement by ~iling to the owner or reputed owner of the property as
shown o~ the tax rolls of the County Treasurer, at the address shown thereon,
a notice setting forth the nature of the p.~.~oposed improvement, the total
est~_n~ted cost and the ~stimated benefits to the particular lot, tract, or
parcel, and the date of the hearing before the city Council at least fifteen
(15) days before the date fixed herein zor such hearing.
Section 6. That '¢~ednesday the ~$~day o£ ~/& , 1953~ at
lO:OC o,clock A.~,~., P.S.T., of said day be and the same is hereby fixed as
tho date of hearing protest against said imp~o'~ements by' any persons interest-
ed therein; and the city Clerk be a~d is hereby authorized and directed to
publish a copy of this resolution in the oi'ficial newspaper of said city for
at least two successive issues, the first issue to be at least fifteen (15)
day~ prior to the date her~i~, fixed for said bearing, and. said publication,
together with the mailing oI' the notices hereinabove provided to the o-maers
or reputed owners oI' the lots and parcels of land included in such improvem.ent
as hereinabove set forth, shall be due and legal notice to all concerned in
said proposed improvement~.
