HomeMy WebLinkAbout861BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BR~ERTON:
Section 1. That the public interest requires the following
improvements to be made.
Section 2. That it is the intention of the City Council of the
City of Bremerton to order the improvement of East 29th Street from
Robin Avenue to Eagle Avenue; Emgle Avenue from East 29th Street
to ninety (90) feet North of East 31st Street; East 31st Street
from Eagle Avenue to Secondary State Highway No. 21-B; Easement line
between Secondary State Highway No. 21-B and Eagle Avenue and South
of East 31st Street; hereinafter to be known as: Eagle Avenue et. al..
By the construction of Sanitary Sewers, together with the doing of
any and all other work in connection ~as may be necessary
to make such improvement a complete job, all in accordance with the
plans and specifications to be placed on file in the Office of the
City Clerk of the City of Bremerton, reference to which is hereby
made for further particulars.
Section 3. That the City Engineer of the City of Bremerton is
hereby directed to submit to the City Council at or prior to the date
fixed for hearing protest~ to said improvements, the estimated cost
and expense of such improvement, and a statement of the proportional
amount thereof, which should be borne by the property within the
proposed assessment district, and a statement of the aggregate assessed
valuation of the real estate, exclusive of improvements, within such
proposed district according to the valuation last placed upon it for
the purpose of a taxation, together with a diagram or plan
shewing thereon the 1.ets,A tracts, and parcels of land and other property
which shall be ~ benefited thereby and the estimated amount of the
cost and expense of such improvements to be borne 1fy such lot, tract or
parcel of land or other property.
Section 4. That the cost and expense of said improvement to be
borne by said improvement district and exclusive of any portion borne
by either the State of Washington or other governmental agency, shall
be assessed against said property included in said improvement district
in proportion to ~aid area, except wherein the special benefits conferred
upon the property are not fairly reflected by the use of the termini
and zone method, the assessment shall be made against the propwrty of
the district in accordance with the special benefits it will derive
from the improvement without regard to the zone and termini method,
and in accordance with the provisions of the Revised Code of Washington
35.~3.080, the remainder of said cost to be paid for if any by arrangement
with either the State of Washington or other governmental agencye
Section 5. That the City Clerk be and he is hereby directed to give
notice of the date of such hearing to the owner or reputed owner of
any and all lots, tracts or parcels of land or other property specially
benefited by the improvement by mailing to the owner or reputed owner
of the property as shown on the tax rolls of the County Treasurer, at
the address shovm thereon, a notice setting forth the nature of the proposed
improvement, the total estimated cost and the estimated benefits to the
particular lot, tract or parcel, and the date of the hearing before the City
Council at least 15 days before the date fixed herein for such hearing.
Section 6. That~the I~l~day of ~ 1954, at
10:00 A.M., P.S.T., of said day be the aame is hereby fixed as the date
of hearing protest against said improvements by any persons interested
therein; and the City Clerk be and is hereby authorized and directed
to publish a copy of this resolution in the official newspaper of said
city for at least two successive issues, the first issue to be at least
prior totihe ~.herein fixed for said hearing, and said publication
together with the mailing of the notices hereinabove prodded to the
o~ers or reputed o~ers of the lots, tracts or parcels of land included
in such improvement as herei~bove set forth, shall be due and legal notice
to a~l concerned in said improvements.
