A RESOLUTION of the City Council of the City of Bremerton, Washington, declaring the City Council's intention to establish a Utility Local Improvement District for the purpose of improvement of a portion of the West 650 Zone distribution water main and setting a hearing date for November ,19~ 2002. WHEREAS, it is in the public interest to provide water main distribution service to a portion of the West 650 Zone; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: SECTIONL That it is the intention of the City Council of the City of Bremerton to order the improvement ora portion of the West 650 Zone distribution water main to be accomplished by installing a 12 inch water pipe, together with the doing of any and all other work in connection therewith as may be necessary to make such improvement a complete job, all in accordance with the plans and specifications on file in the Office of the City Engineer of the City of Bremerton, reference to which is hereby made for further particulars. The ronte along which the improvement is to be constructed is attached as Exhibit A and incorporated herein by reference. The territorial extent of the improvement is attached as Exhibit B and incorporated herein by reference. SECTION2. The total estimated cost and expense of the improvements is declared to be $1,049,370, of which $120,716 of that cost shall be paid by the City and the remainder thereof to be borne by and assessed against the property specially benefited by the improvements to be included in a utility local improvement district to be established embracing as nearly as practicable, all the property specially benefited by the improvements. Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the improvement adds to the property. Such assessments shall be paid into the W650 ULID Project Account of the City's Current Water Fund for the payment of revenue bonds issued to pay the costs of the improvement. 1 W650 ULID SECTION3. The Director of Public Works and Utilities of the City of Bremerton, or his designee, is hereby directed to certify to the City Council at or prior to the date fixed for hearing protests to said improvements, a description of the boundaries of the district, the estimated cost and expense of such improvement, and a statement of the proportional amount thereof which should be borne by the property within the proposed assessment district, a statement of the aggregate assessed value of the real estate, exclusive of improvements, within such proposed district according to the valuation last placed upon it for the purpose of a general taxation, together with the estimated amount of the cost and expense of such improvements to be borne by the lots, tracts, or parcels of thc land or other property which shall be specially benefited thereby. The Director is also to submit a diagram or print showing thereon, the lots, tracts, and parcels of land and other property which will be specially benefited by the proposed improvement and the estimated amount of the cost and expense thereof to be borne by each lot, tract, or parcel of land or other property. However, such diagram will not be required where such estimates are on file in the Office of the City Engineer, together with a detailed copy of the preliminary assessment roll and the plans and assessment maps of the proposed improvement. SECTION 4. The City Clerk is hereby directed to give notice of the date of such hearing to each owner or reputed owner of any and all lots, tracts, or parcels of land or other property specially benefited by the improvement by mailing to the owner or reputed owner of thc property as shown on the tax rolls of the County Assessor, at the address shown thereon, a notice setting forth the nature of the proposed improvement, the total estimated costs, and the date of the hearing before City Council, at least fifteen (15) days before the date fixed herein for such hearing. Notice must state that the actual assessments may vary from estimates so long as they do not exceed a figure equal to the increased true and fair value of the improvement, and the estimated benefits of the particular lot, tract, or parcel. SECTION 5. The City Clerk is hereby authorized and directed to publish a copy of this Resolution in the ofticial newspaper of the City of Bremerton for at least two successive issues, the first issue to be at least fifteen (15) days prior to the date herein fixed for said hearing, and said publication, together with the mailing of the notices hereinabove provided to thc owners 2 W650 ULID or reputed owners of the lots, tracts, or parcels of land included in such improvement as hereinabove set forth, shall be due and legal notice to ail concerned in said improvements. SECTION6. All persons who may desire to object thereto are hereby notified to appear and present such objections at a public hearing before the hearing officer to be held at City Council Chambers, City Hall, 239 Fourth Street, Bremerton, WA 98337, on the 19th day of November, 2002, at 9:00 a.m. or later, which time and place is hereby set for heating of matters relating to said improvements and all obiections thereto. SECTION 7. The City Council hereby designates Theodore Paul Hunter or James M. Driscoll, of the firm Driscoll & Hunter, as the appropriate officer to conduct the public hearing scheduled herein, and to report reconmaendations on the resolution to the City Council for final action. SECTION 8. Severabilim If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. SECTION 9. Effective Date. This Resolution shall take effect and be in force immediately upon its passage.
