A RESOLUTION APPROVING THE REZONE OF THE SW CORNER SYLVAN WAY AND
WHEATON WAY, BREMERTON, KITSAP COUNTY, WASHINGTON.
WHEREAS, Peter Powell has applied for a rezone for the SW Comer of Sylvan Way and Wheaton
Way from single-family residential (SF-3) to Professional Office (PO); and
WHEREAS, the Planning Commission on March 21, 2000 reviewed and recommended approval of
the fezone; and
WHEREAS, an environmental checklist has been prepared and considered by the responsible
official and a determination ofnonsignificance issued on October 29, 2000;
WHEREAS, the City Council has received the Planning Commission recommendation, meeting
transcript, and staff report;
NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Bremerton does
hereby find:
1. As set out on page 8 of the staff report, the Comprehensive Plan designation for the site
is General & Professional Offices (C-P). The "SF-3" zone is not allowed under the "C-
P" designation. The "PO" zone is allowed under the "C-P" designation. The rezone is
consistent with the comprehensive plan.
2. As set out in Finding Number 1, the present zoning is inconsistent with the
Comprehensive Plan and has been since it was adopted. The rezone will therefore
correct a classification that was inappropriate when established.
3. As set out in Findings Numbers 1 and 2, present zoning is inconsistent with the
Comprehensive Plan. Additionally, the City has, through the Comprehensive Plan
process, deemed the site appropriate for "PO" zoning. It is in the public interest for
zoning to confoma with the Comprehensive Plan as required by law. The rezone
therefore dearly benefits the community of Bremerton.
4. As set out in the staff report, especially on pages 9 and 10, all essential public facilities
and services are available and adequate for this fezone.
5. As set out on page 2 of the staff report, the site is adjacent to present commercial
development. As further set out in the staff report and in Finding Number 1, the site is
designated for commercial development in the Comprehensive Plan. The rezone will
not create an isolated development or "spot zone."
BE IT FURTHER RESOLVED, that the City Council of the City of Bremetton does hereby
rezone the following parcels from "SF-3" to "PO": 3955-001-001-0006; 3955-001-002-0005; 3955-
001-003-0004; 3955-001-004-0003; 3955-001-005-0002; 3955-001-006-0001; 3955-001-007-0000;
3955-001-008-0009.
