HomeMy WebLinkAbout2422RESOLUTION NO. 2422 A resolution approving official maps for use in the prosecution of RCW 69.,50.435 (manufacturing, selling, delivering, and possessing controlled substances in certain public places). The students or Bremerton High School with the support of othcr students in the Bremerton School District propose to reinforce the "Drug Free Zone" statute of the State of Washington (RCW 69.50.435). The statute allows municipalities and school districts to create a 1,000-foot boundary zone around all schools an'd school properties and public parks. Anyone caught dealing illegal substances within one of these zones is subject to a more severe penalty. The Seattle School District implemented this program in June, 1991 and has had over 170 convictions within their Drug Free Zones since that time. The students of the Bremerton School District believe that the same level of success can be acheived in Bremerton. As leaders in the community, the studends, in conjunction with civic leaders, would take on the responsibility of publicizing these Drug Free Zones. Publicity like distributing flyers, telephoning, door-to-door calls, and a student march would be organized to let the community know that drug dealing will not be tolerated by the students of Bremerton. ]'he Bremerton High School constitution states that "the (Associated Student Body) of Bremerton High School endorses and. supports a ... drug free environment." The students believe that attaining a Drug Free Zone around each school will positively enforce this code of conduct. The students understand that the state law will not stop drug use in our community but transfer such use away from educational facilities, making them safer places to learn. The students of the Bremerton School District are highly concerned with the growing drug problem in and around the schools and feel this is a considerable disruption to the educational process. The overwhelming concern for personal safety and the violation of their right to learn will no longer bc tolerated by the students of the Brcmerton commtmity. WHEREAS the City Council and Mayor of the City of Bremerton support the efforts of the students of the Bremerton School District, and WHEREAS RCW 69.50.435(e) provides that in a prosecution under this statute, maps produced by the municipal engineer depicting the locations and boundaries of the areas depicted above, shall, under proper authentication, be admissible in court, and shall constitute prima facie evidence of the location and boundaries of those areas, if the governing body of the municipality has adopted a resolution approving the maps, now therefore BE IT RESOLVED by the City Council of the City of Bremenon: 'Ihat the attached maps are hereby approved as the official record of the location of schools, the boundaries within one thousand feet (1,000') of the perimeter of school grounds, and the location of public parks. BE IT FURTHER RESOLVED that the maps approved herein shall be filed with the City Clerk and shall be maintained as an official record of the municipality. PASSED by the City Council of the City of Bremerton this 16th day of December, 1992. LYNN HORTON, Council President APPROVED this 21 day of December, 1992. LOUIS MENTOR, Mayor ATTEST: KATHLEEN L.
