WHEREAS, the Bremerton-Kitsap County Health District has found that surface waters of Dyes Inlet are being adversely impacted by nonpoint source pollutants, such as fecal coliform bacteria from failing on-site sewage systems, and has recommended action to correct failing systems; and WHEREAS, the City of Bremerton has a primary obligation to its citizens to allocate limited service resources for adequate growth and development within the City and has adopted a policy through BMC 15.03.040to require annexation or support of annexation to the City as a condition of receiving City utility service; and WHEREAS, the City of Bremerton agreed in September, 1993 as part of a Consent Decree under the Federal Clean Water Act, to initiate annexation of the Rocky Point peninsula and to include this area in its sewer service area if annexation is successful in order to make sanitary sewer available to this area to alleviate degradation of Dyes Inlet from failing private septic systems; now, therefore, BE IT RESOLVED by the City Council of the City of Bremerton: 1. That protection of the waters surrounding the City of Bremerton promotes the health and prosperity of its citizens, and the Council finds that the best interests and general welfare of the City would be served by the annexation of the unincorporated area of the Rocky Point peninsula contiguous to the City to allow allocation of sewer capacity and planning of future system extension to this area. 2. That the City of Bremerton requests an election be held to consider the question of annexation of the area more fully described and depicted in Exhibit "A" attached hereto and incorporated by reference herein to the City of Bremerton, and that a certified copy of this resolution be filed with the Kitsap County Commissioners Office and Kitsap County Auditor as a request to hold this election on November 8, 1994 pursuant to RCW 35.13.015, or the next available special election date under RCW 29.13.020if requisite approvals delay setting the election beyond this date. 3.
