HomeMy WebLinkAbout2717 RESOLUTION # 2717
A RESOLUTION reviewing a Non-administrative Special Use Permit to
allow an automotive service use including repair, detailing, and minor body
work in a residential zoning district at 1533 Shorewood Drive as a
replacement nonconforming use of less intensity than an existing
nonconforming use.
WHEREAS, Bremerton Municipal Code Section 21.02.790 (d) allows another nonconforming use to
replace an existing nonconforming use by Special Use Permit when it is:
· Clearly a reduction in the nonconformity or intensity,
· Or, when the new use is found to be uniquely suited to existing buildings, structures, or other site
improvements which themselves may be legal nonconformities; and
WHEREAS, Jonathan H. Chang has applied for Planning Application PL99-0006 for a Non-
administrative Special Use Permit (SUP) on March 25, 1999 to allow a nonconforming automotive
service use to replace a previous nonconforming sign shop use at 1533 Shorewood Drive in a residential
zoning district; and
WHEREAS, pursuant to the State Environmental Policy Act (SEPA), the City issued a threshold
Determination ofNonsignificance (DNS) on the proposed use; and
WHEREAS, the Bremerton Planning Commission held a public meeting on May 18, 1999 to review
Mr. Chang' s application and recommended that the proposed use be denied; and
WHEREAS, the City Council has conducted an open record public hearing on this SUP on July 14,
1999.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Bremerton hereby finds:
1. The proposed use would increase problems with parking, traffic, circulation, noise, and air quality;
and
2. That the proposed automotive use is not a less intense nonconforming use than the existing
nonconformity; and
3. The proposed use has not been found to be uniquely suited to the existing buildings.
BE IT FURTHER RESOLVED, the City Council of the City of Bremerton does hereby deny PL99-
0006.
PASSED, by the City Council of the City of Bremerton this 14th day of July,
1999.
