This is an application pursuant to BMC 21.02.520 for aone year extension of time limit for action on a preliminary plan for a PUD. The PUD at issue is commonly known as West Hills PUD. 2. The Council opened a public hearing on an emergency basis on 12 May 1999 and was cntinued, with proper notice, to 19 May 1999 and accepted into the record and r~iewed the application, the staff analysis and re~mmendation, and evidence from citizens, including testimony. 3. The Council approved the Preliminary Plan on 14 May 1997. No Final Plan has been submitted. 4. Olympic Group has made progress by 1) submitting final engineering and grading plans; 2) acquiring easements for and the construction of over 0.5 miles of sanitary sewer lines at a cost of $460,000; and 3) the applicant is in preparation to conduct rough road grading for the main entry road and grading preparation for a building pad on lot 19 to begin later this year. 5. It is very likely a Final Plan would be submitted within the one-year extension period requested because 1) final engineering plans for many of the key applicable improvements such as street, waste disposal, water and drainage have been made; 2) other plans can readily be addressed within the one year time extension; and 3) it is reasonable to expect any Covenants, Conditions and Restfictions can be completed within the one year time frame. CONCLUSIONS 1. The Preliminary Plan would expire 14 May 1999 unless either a Final Plan were submitted or an extension granted pursuant to BMC 21.02.520(a). 2. Olympic Property Group has timely filed for an extension. 3. Olympic Property Group has shown that it has made progress under the Preliminary Plan and has shown that it is very likely that a Final Plan will be submitted with the one-year extension requested here. THEREFORE BE IT RESOLVED that Olympic Property Group's application for an extension is approved. Dated this 19th day of May 1999.
