A resolution awarding a construction contract for Callow Avenue Basin Priority I, Phase 2, Storm
Drainage Separation
WIIEREAS, the City Council finds that R.L. Alia has claimed its bid was based on an error and
has notified Bremerton it is withdrawing its erroneous bid; that said contractor would remain the
lowest responsible bidder if it's bid is corrected for this reported error; and that the City' s utility
ratepayers will benefit by entering into a corrected contract and obtaining the improvement at
reasonable cost, and
WHEREAS, the City has been temporarily restrained from awarding the contract at the corrected
bid pending a decision on continued injunction in Kitsap County Superior Court Cause No.
97200329, now therefore
BE IT RESOLVED BY THE BREMERTON CITY COUNCIL
The Contract for Callow Avenue Basin Priority I, Phase 2, Storm Drainage Separation, Project
No. V4214 is awarded to R.L. Alia Company of 3,458,034.00, provided the bid may be awarded
to Alia for the corrected amount of $4,145,034 should Alia fail to execute the contract at its
original bid and the corrected award is not otherwise enjoined in Kitsap County Superior Court
Cause No. 97200329.
BE IT FINALLY RESOLVED that if the contract is not executed by Alia as described above all
bids shall be rejected and the project rebid.
