HomeMy WebLinkAbout2621RESOLUTION NO. 2621)
A Resolution Setting a Moratorium on The
Development of Docks and Piers Within the
Channel between Ostrich Bay and Oyster Bay
WHEREAS the Shoreline Management Act of 1971 requires the Bremerton
City Council to adopt a Bremerton Shoreline Master Program which the
State reviews and adopts as part of the Washington Administrative Code;
and,
WHEREAS the Bremerton City Council finds that the current Bremerton
Shoreline Master Program does not adequately address the following
issues in the Oyster Bay Channel:
A. The level of potential navigational hazards created by docks and
piers requiring substantial shoreline development permits in the Channel
between Ostrich Bay and Oyster Bay;
B. The aesthetic quality of large docks and piers in the Channel
between Ostrich Bay and Oyster Bay;
C. The environmental and public trust issues (public waters and
underlying lands are a public resource owned by and available to all
citizens equally for navigation, fishing, recreation and similar uses) related
to docks and piers which rest directly on the beach at low water; and,
WHEREAS the Council understands that the City of Bremerton public use
of shoreline may suffer irreparable damage if development is not
prohibited while regulations are changed: and,
WHEREAS the Bremerton City Council believes that a study period is
necessary to process the change locally (estimated at 2.5 months for
developmental work, public notice, Planning Commission hearing and City
Council hearing); and,
WHEREAS the State Department of Ecology is allowed 5 months to review
and implement changes to the Administrative Code amending the
Bremerton Shoreline Master Program; and,
WHEREAS such delays may result in permits being filed under current
regulations which may seriously impose navigational and environmental
hazards; undesired situations involving the public trust of the shoreline
and well as cause a loss of irretrievable aesthetic quality;
NOW THEREFORE BE IT RESOLVED BY THE BREMERTON CITY COUNCIL
1. That a development moratorium prohibiting the development of
docks and piers and issuance of substantial shoreline development
permits for all Docks and Piers within the confines of Oyster Bay Channel
as defined on Exhibit A is hereby adopted;
2. That this moratorium shall take effect immediately and should
terminate 9 months from the date of this moratorium or until an amendment
to the Bremerton Shoreline Master Program can be approved by the State
Department of Ecology, whichever shall occur first.
