A RESOLUTION providing for the payment
of attorney fees incurred on behalf of
the Bremerton Civil Service Commission.
WHEREAS, the Bremerton Civil Service Commission is
a department of city government established by charter and
composed of volunteer members appointed by the Mayor and City
Council, and
WHEREAS, the Civil Service Commission is to be represented
in legal matters by the City Attorney for the City of Bremerton,
except in those instances where a conflict might occur between
the Bremerton City Council and the Bremerton Civil Service Commission
in which cases special counsel may be appointed if first approved
by the Bremerton City Council, and
WHEREAS, the Bremerton Civil Service Commission,
believing that it was necessary to obtain legal assistance because
of a believed conflict between the Bremerton Civil Service Commission
and the Bremerton City Council, retained the services of Merrill
Wallace, an attorney practicing in the City of Bremerton, and
therefore incurred an obligation to Merrill Wallace for payment
of fees and costs expended by him and,
WHEREAS, although the Bremerton Civil Service Commission
acted without the necessary statutory authority in incurring
special legal expenses, it is the desire of the Bremerton City
Council to insure that legal expenses and costs incurred on behalf
of the City of Bremerton and its departments be paid,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Bremerton that the statement for services rendered
on behalf of the City of Bremerton and its Civil Service Commission
by Merrill Wallace in the amount of $800.00 , together with
his costs expended in the amount of $460.70 , be approved and
paid, and that the Clerk be directed to issue a warrant~ for the
sa~e .
ADOPTED by the City Council of the City of Bremerton,
signed by the Mayor and attested by the City Clerk in authentication
of such adoption this 15th day of November, 1972·
