A RESOLUTION requesting the State Legislature to
amend RCW82.38,080 to expand the special fuel tax
exemption to all diesel fuel operated equipment
operated by local governments.
WHEREAS, RCW82.38,080 exempts from the Special Fuel Tax
Act, RCW82.38, the use of diesel fuel for street construction
and maintenance equipment, fire fighting equipment and power
pumping equipment owned and operated by a local government and
WHEREAS, the monthly reporting requirements of RCW82.
38,150 create an additional responsibility for the local govern-
ment whether any diesel fuel was used or not, and
WHEREAS, the City of Bremerton operates only one piece
of diesel fuel operated equipment that is not exempt from RCW
82.38 and the tax due from its operation creates a small revenue
impact for the Department of Motor Vehicles;
WHEREAS, the City of Bremerton believes the majority of
local government operates an insignificant number of non-exempt
diesel powered equipment which similarly provides a small amount
of revenue for the Department of Motor Vehicles;
NOW, THEREFORE, BE IT RESOLVED that the City of Bremerton
encourage the Washington State Legislature to review RCW82.38,080
and amend this provision to expand the exemptions contained therein
to all diesel fuel operated equipment thereby removing the responsi-
bility of filing reports and submitting Use Tax Payment.
PASSED by the City Council of the City of Bremerton,
signed by the Mayor and attested by the City Clerk in authentication
of such passage this 29th day of September, 1976.
