RESOLUTION NO. 1707
A RESOLUTION establishing the procedure to be
followed by the City of Bremerton with respect
to a motor vehicle accident in which there is
a fatality.
WHEREAS, the City of Bremerton desires to ensure that any
motor vehicle accident in which a person is killed is reviewed as
to the possibility of the chargednegligent homicide by a motor
vehicle beino brought against the person responsible for the fatality.
WHEREAS, the City of Bremerton does not have statutory
power to provide punishment commensurate with the seriousness of the
crime of negligent homicide by a motor vehicle.
WHEREAS, the State of Washington has passed a law pro-
viding for the punishment of a person found guilty of negligent
homicide by a motor vehicle.
WHEREAS, the County of Kitsap is empowered to enforce
the laws of the State of Washington, therefore
BE IT RESOLVED that copies of any and all reports pre-
pared by the Bremerton Police Department in the investigation of
a fatal motor vehicle accident occurring in the City of Bremerton
be forwarded to the Kitsap County Prosecutors Office so that the
possibility of a charge of negligent homicide by a motor vehicle
may be investigated.
BE IT FURTHER RESOLVED that no citation shall be issued
by the City of Bremerton pursuant to an accident involving a motor
vehicle when there is a fatality until such time as the case is
reviewed by the Kitsap County Prosecutors Office and a recommendation
is received from that office.
PASSED by the City Council of the City of Bremerton,
signed by the Mayor and attested by the City Clerk in authentication
Of such passage this 16th day of March, 1977.
