MEMO
TO : CITY COUNCIL
FROM: ANDREW W. OLSEN, Assistant City Attorney
RE : AFFIRMATIVE ACTION RESOLUTION
Mayor Jarstad has asked this office to prepare a memo-
randum explaining the legal background to the Resolu-
tion now before the Council concerning the adoption
of goals and timetables for the implementation of the
City's Affirmative Action Employment plan.
In short, there are several, primarily federal, agencies
who have, and may in the future have, power to review
City employment policies relative to funds and ac-
tivities which these different agencies supervise.
Although one of these agencies may not require an
affirmative action plan, the fact that the City has
"voluntarily" adopted such a plan will in our opinion
be of great assistance in gaining approval upon agency
review. Discussions last summer with representatives
from Housing and Urban Development affirmed this.
Further, "Revised Order No. 4" issued by Office of
Federal contract compliance on December 3, 1971
under authority of Executive Order 11246 requires
non-construction contractors with fifty (50) or more
employees and a contract of $50,000 or more to take
affirmative action, particularly in setting goals
and timetables for the employment of minorities and
women in job categories where they have been under-
utlized.
Very truly yours,
ANDREW W. OLSEN ~t
