City Engineer, The City Council of the City of Bremerton do ordain as follows: Section 1. ThaL all those certain streets, avenues or highways lying and being between that certain te~'rltory bounded en the North by Ninth Street, on the South by Sixth Street, on the east by Pacific Avenue; Seventh Street from the west margin of Warren Avenue; Eighth Street from the west margin of Park Avenue to the east m~rgin of War~,en Avenue and ~nion Street (also known as Jacobsen Street) from the west margin cf Park Avenue to the East, mar~in of Warren Avenue, by clearing, grubbing, grading, sidewalking and guttering the same, except the alleys which shall only'be cleared and graded sufficient to make them passable with teams, and doing such other work as may be necessary in connection therewith, all in accordance with plans to be prepared by the City Engineer. Section I1 That all the cost amd expense of said improvement including all necessary and incidental expenses shall be borne by and assess-~ ed against the property included in the assessment district hereinafter created in accordance wt. th law. T.he City of Bremsrton shall not be liable in any manner for any portion of the cost or expense of said improvement. SEction III. There is hereby established a Local Improvement District Ne. 61 which said district is described as follows: All the prop- erty between the termini ef said improvement, abutting upon, adjacent,vicinal er proximate te such p~rtion ef said streets and avenues tea distance back from the marginal lines thereof, as prevlded by law. Section IV. Bonds bearing interest at the rate ef seven per cent per ~annum· payable en er before ten years from the date of issuance, shall be issued in payment ef the cost and expense ef this improvement· which bands shall be redeemed by the cellectie, n ef special assessments te be levied and assessed upon the property within said district, payable in ten equal annual installmants with interest at the rate ef seven per ~ent per annum under the mede of "Payment by Bends" ' · as defined by law and the Ordinances ef the City of Brcmerten. ·These shall be delivered te the contractor in redeml~t, ien ef warrant~ ~x th~ Local Imp?o~ror~ont fu~d issued on estimates ef the City Engineer, er the City ef Bremerton may at its election sell said bends and make such redemption in cash. 'Section V. It is further provided that, any owner er owners within the said district may upon suqh terms as may be agreed upon by the City Eng- ineer and the c~ntractar in charge ®f said wer~, with the concurrence ,f the City O®uncil, i~ave special work d~ne upon any premises of such property owner or owners and situated within the said district upon signing such agree- ment or stipulation as may be required by the City Council, the cost of such special work on said premises to be added to the amount of the assessment otherwise to be charged solely against such property and included in and carried on the assessment roll hereafter reported against the property with- in said district and to be included in the amount of the bonds issued against the said district and to be included in the amount of the bonds issued against the said district. Section VI. This Ordinanoe shall be in full force and effect from five days:after its passage, approval and publication.
