HomeMy WebLinkAbout0421 An Ordinance providing for the improvement of Washington Avenue from its intersection with Pacific Avenue to the north margi~ of Burwell ~Street; Pacific Avenue from its intersection with the south line of that, certain allley running along the southern side of Block One,extended North to the Soutt~ margin of 'Fourth Street; Front Street from the ~avy Yard fence to the line 0F 1ow tldei ~e0ond ~trect from Paoi. flc Avenue to the South :margin of Washington &venue~ Burwell Street from Pacific Avenue to Washing- ~ ton Avenue; that certain alley running along the west side o~ Blocks eiewen and twelve of the plat of Bremerton; that certain alley running north and south through blocks n~ne and t,en of the plat of Breme?ton; that certain alley running in a northeasterly and southwesterly direction through Blocks seven and eight of the plat of Bremerton; that certain-~alley running from Front Street to Pacific Avenue on the soutilerly ~ide of Block One .of the plat of Bremerton~ that certain alley running east and west along the north end of Block twelve of the plat of Bremerton, and that certain alley running east and west through the major portion of Block eight of the plat of Bremerton by paving all of the same, by grading,, stdewalking and gut%sting such portions of same as may be necessary and to do' all ether or proper work incidental thereto or necessary; in order .to make the said .job ofpa~in~,sidewal~ing,gutt- sting a complete job, all in accordance with plan~ prepared and on file in the office of the City Clerk, and in accordance with a resolution passed by t~e City Council of the City of Bren~erton on the i~th day of Nay, 191~.; creating Local Improvement District No, ,58 and providing that payment for the said improvement shall be made by special assessments upon the prqperty in-said district abutting upon or contiguous and proximat~ to the said improvement,and payable by the mode of "Payment by Bonds." The City Council of the Cuty of Bremerton do ordain as follows: Sectionl, That Washington Avenu~ from its Intersection with Pacific ~ '~ Avenue to the north margin of Burwell Avenue; Pacific Avenue from its intersectio~ with the south line of that certain alleyrunning along the southern side of Block One, extended North to the South margin of Fourth Street; Front Street from the Navy Yard feAce to the line of lo~ tide; Second Street from Pacific Ave~n~e to the South margin of Washington Avenue; Burwell Street from Pacific Avenue to Washington Avenue; that certain alley running along the west, side o~ Blocks eleven andtwelve of the plat of Bremertnn; that certain alley ru~u~ing north an south through blocks nine and te~ of the plat of Bremerton; .that certain alley running in a northeasterly and southwesterly direction through blocks seven and eight of the plat of Bremerton; that certain alley running from Front Street to Paci~'~c Avenue on the southerly side of Block One of the plat of Bremerton; that certain alley rurnling east and west along the north end of block twelve of the Plat of Bremerton, and that certain alley r~n~ning east and west through the major portion of block eight of the plat of Bremerton, by paving all of the same, and by grading, stdewa king and guttering ~eho~ortions of the same ~s may be necessary, and by making such repairs or additions to the se~:~er system in the said streets or to the water or salt water main pipes of the City of Bremerton or to the hydr~nts, and to do all other proper work incidental to or ~pDroopra[te in order to make the said job of pavin~ a complete job and to finish the said streets, all in accordance with plans and speclficatio~i,.s on file in the office of the City Clerk. Section '2. That all the ~ost and exepnse of Said improvement ~ncluding all necessary and incidental expenses shall be borne and assessed against the propoerty included in 'the assessment district hereinafter created in accordance with law. The City of Bremerton shall not be liable in any ~ner for any port- of ~ection 3. ~here is hereby established a Local Improvement District' to be called "Local Improvement District No,58 , which said diet?let is described as foll~w~: All the property between the t~rmini of said improvement abutti~g to a distance back from the margl~l lines thereof, as provided by law. Section 4. Bonds bearing interest at the rate of seven (7~) pe~ cent per and-aim, payable on or before ter~ years from the date of issuance, shall be issued i~ payment of the cost and expe~'~se of this improvement, whO.ch 10onds shall be redeemed by the collection of special assessments to be levied and assesses ainst the property within ~3aid district, payable tn ten equal an'nual installments with interest, at the rate of seven (7~)per cent per an~, under the mode of "Pay- ment by Bonds" as ~efined by law a~d the 0rdina~'~ces of the City of Bremerton. Thes~ bonds shal'l be delivered to the conthactor in redemption of warz~'ants on the Local Improvement District fund issued on estimate of the City Engineer, or the City of Bremerto'~ may at its electio~'~ sell said bonds and make such redemption ~.~ ~,ection 5. It is fu~-ther provided that any owner or ownees within the sa~ 4istrlct ,nav,~ upor~ such terms, as may be agreed upon by~ the City En~inee~,~ and the co~tractor in charge of s~ work, with the concurrence of the City'Counuil, have special work done upon any premises of such property owner or owners and sit- uated within the said district upon signing such agreement or ..stipulation as may be required by the City Council, the cost of such special work on ~id premises such property and included ~.n ah~ carried on the assessment roll hereafter report- of the bonds issued against the said district.
