HomeMy WebLinkAbout0413 AN ORDINANCE providing for the improvement of Vlashington ~venue from its intersection with Fourth Street and from the present manhole at the inter~ection of Washington Avenue and Front ~%treet to the present manhole at the intersection of Pacific Avenue and ~as~ington Avenue, by laying therein a sewer and doing such other work as may be necesmary in connection therewith, all in accordance with pla~ prepared and on file in the office of the City C~erk. and in accordance with a resolution passed by the 0ity Council of the City of Bremerton. creating a local improvement dsitrict therefor on the 26th day or,February, 19~2, and providing that payment for said improvement be m~de by special asse~zments upon the property of said dlstriet pmyable by the mode of "X'ayment By Bonds." The City Council of the City of Bremerton do Ordain as follows: Sec. 1. That Washington Avenue from its intersection with ~ourth Street to its intersection with Second Street and from the present manhole at the intersectio~ of Wa hing~on Avenue and ~ront Street to the present manhole at the intersection of Pacific Avenue and ~shington Avenue, be improved by laying therein a sewer and by doing such other work as may be necessary in connection therewith, according to the plans and speciflc~tions therefor prepared undor ~he directitn of the City Engineer and on file in the Iffice of the ~ity Clerk. Sec. 2. That all the costs and expense of said improvement, including all necessary and incidental expenses, shall be borne and assessed ag~inst the pr.~per- ty included in the assessment district hereinafter afeared in accordance with law. The 0ity of Bremerton shall not be liable in any man, er for any portion of the cost and expense of said improvement. Sec. 3. That thereis hereby established a local improvement district, to be called Local Improvemtn~ ~istrict No. 56, which said district is an enlarged district and sh~ll pay the whole cost and expense of said improvement, the same to be assessed against the prop,rty within the ~aid district, T~e boundaries of and property included within such enlarged district are hereby described and specified as foll~ws: All that property abutting on the said improvement between the termini thereof as hereinbefore set forth, and also all the property abutting of Second Avenue to a point 60 feet east form the east margin of Pacific A~enue and to the center of blocJks on each side of said street and on the street herein- before described betw~een~he *~rmini of said improvement, and al~o all that cert~in property abutting on the west a~de of ~akhington Avenue north from the northern terminus of s~id improvement to a point 28& ffet north of the north margin of Sixth Street and extending back~n the west side of said portion of Washington Avenue to the middle of the blocks on the said west side thereof. Sec. 4. That ~here be assessed against that p~rtion of the property within such enlarged district lying between the termini of the proposed improvement and extending back from the marginal lines thereof to the middle of the block on each side thereof in the mode prescribed in Section 13 el Chapter 98 of the Session Laws of ~he State of Washington for 1911, seventy-fi~e per cent of the cost and expense of such improvement and that the remainder of such cost and expense be dis- tributed and assessed against all the property included in the remainder of such enlarged district in accordance with special benefits. Sec. 5. Bonds bearing interest at the rate of seven per cent ocr ann~n, payable on or before five years from the da~e of issuance, shall be issued in payment of the co,ts and expense of this improvement, which bonds shall be redeemed by the collection of s~eci~l assessments to be levied and assessed upon the property within said district payable in five equal annual installments, with interest ~t the r~te of seven per cent per ~nnum, under the mode of "Pa~nent By Bonds"as defined by law and the ordinance s of the ~ity of Bremerton. These bonds shall be delivered to the contractor in redep~ion of warrants of the Local Improwement District ~und issued o~ estinates of the City Engineer, o~ the Oity of Breme~ton may at Ars election sell said bonds ang make such redempti~n in cash.
