D. 1916, ~d creating Local Improvement District No. ~8 providi~ that the ~ent for said t~provement shall be made by special assessments upon .the property in said districts abutting upon or contiguous or approximate to said property, and payable by the mode off "payable by bonds". ~,,~ 6i~ ~u~i0i~ ~' T~E CITY 0~ Bi~M~RTON DO Oi~D,iIN AS FOLLOWS: Sec. 1. That Elizabeth Street from the center line of Belson Street south to the center line of Ninth Street be improved by constructing thereon a combined stor~ and sanitary sewer, along with the necessary Ys, branches, c~.tch-basins, man-holes, inlets ~d lateral sewers, also an2~ ~d all draining, grading t~nd lamp-holes, and b~ doing such other and further work in connection ~herewith as may be necessary to make said improvement a complete Job ~ll in accordance with the plans and s~eci~'ications prepared, and on file in the office of the City Clerk; and to do all things necessar~ in the premises in accordance with the resoluti,on passed by the City Council of the 0ity of Bremerton J~e l~th, 1916. Sec. B. That all the costs and expense of a~id improvement including all nec- essary and incidental expenses, shall be borne by and assessed against the property included in the assessment district, hereinafter created, in accordance ~'~ith law. Th ClSy of Bremerton shall hot be liable in any ~er for any portion of the cost and expense of said improvement. Sec. Z. That there is hereby established and created a Local I~provement Dis- trict No. 78 the'bo~daries of which district are hereby specified and ~escribed as follows, to-wit : Commencing at the northeast corner of Block ~, Warren Smith~ Acre Tracts, thence wes~ to ~he center of s~id Block S, thence south along centez line of said Block 5 of Warren S~ith's Acre Tracts; ~hence south to the center line of ~he Block ~own as Klingha~,~er's Addition and Second Addition and oontinuin~ south through t~e center line of Blocks, l, E and Z of Central Addition to Bremerton, to the Center of Ninth street, thence East along the center lin,~ of }~inth Street to the center line of the Blocks ~etween Elizabeth ~d Pakd :treets to the south ~rgin of L~elson Street, then~e west along the ~outh mt~rgin of Nelson Btreet to the ~oint of beginni~. Sec. 4. That said costs and expense of said i~uprovements aforesaid shall be assessed against said property included in said improve~]ent District in proportion to area and in t~ccordance with ti-~e provisions of Section E of Chapter 168 of the ~ession Laws of 1915, of the ,,rate of Washington. Sec. 5. ~nds bea~.-ing interest at the rate of ? per cent per a~tu~ payable on 0r before 5 years from the date of issnance shall be issued in pa~ent of the cost ~d expense of said improve~ent which bonds shall be redeemed by thei~ollecti,on of special assess~ents to be levied and assessed upon the property with~said district, payable in ~ equ~%l annual installments with intere~t at the ~ate of ? per cent per ~n~,, ~der the mode of "pa~ent of Bonds" as defined by l~w and t}~e ordinaces of t}~, City of Bremerton. These bonds s]~all be delivered to the contractor in redemption of war~ants on the Local Improvement District P~d issued on estimates 3f th,~ City Engi- neer, or the City of Bremerton may at its election sell s~id bonds and make ~'uch redempti~)n in cash. Sec. 6. This ordinance shall be.in full force and effect five (~) days from an,f after its passage, ap~roval and ~ublication.
