HomeMy WebLinkAbout0530 ~~ O~DI~IANCE~ to prevent the ~preading of noxious weeds and ~elating to the dutie~of em~ners, lessees, oocupeirs ~nd agents of lands and lot.~ in the C~ty .of Br.emer~n, Washington, an,~ providing a penalty for the violation thereof. \ \ Sec. I~ It shall be the duty of every owner, lessee, occupant or agent thereo or ~ny person having ~he charade, or care, of any lots or lands, improved or unim- proved, enclosed or unenclosed, in the City of ~remerton, to cut down .or otherwise destroy all noxious weeds growing thereon, or any road, street or highways to the center there?.f~ordering on any such lands or lots~, and on all p~rking strips on streets frontlngkor abutting on said lands or lots as aforesaid, so or,em in each and every year as~shall be certain to prevent them from going to seed. Sec. ~. Ever~owner, lessee, occup~mt, agent or person havxng the care or ch~rge of an~ ~'h l~nds or~ lot~ shall knowingly suffer any~ noxious weeds to grow thereon, and .shall ,~e~mit ~ne seeds of any such noxious weed~ ~o ripen, he shall be guilty of a misdemeanor, and sh~ll be punished b~ a fine not to e~ceed OZ00.00 or by imprisomuent in t~e city jail for not more than 90 days or by both such fine and im~rison~ent. ~ Sec. ~. It shall be ~he dut~ of the thief~of Police of the City of Bremerton to issue and subscribe notfQes directed to each and all of said owners,les:~ees and ~ccupants, notifying them to,~oomply with the provisions of this ordinance: which ~aid notices ~hall require t~ persons ~t. herein named to cause said noxious w~eds to be out down ~nd destr~ye~ within ten d~s from the ti~ae of serving, mailin~'~r cost lng said notices; such ~ervioe~shall be made as follows: On a resident within ~he city, i ~ersonall ~,,? on non-resideniden~ss of the city, by m~ilin~ g ~ copy~ of sa~d~, notice in all cases where the addrese or ~i~ee of residence is unknown b~ l~cinE a copy of said notice up.on said land il~ ew of the travelling public, Sec, 4. Sec. E. That the said Chief of Polic~ shall keep an accurate account of the expenses incurred by ~im in c~rrying out th~ provision ,of tbisor~tinance in respect to each parcel .of land entered upon tZ~erefor~ and the City Attorney for the City of Bremerton shall cause to be served, mailed or, posted a statement of such expenses, includ~ing description .of the lands, verified b~ oath of t~e Chief of Police, to the owner, lessee, occupant or agent, or person ~mv~ng charge of said land, together with a statement naming a time whom the matter wlkll be brought before the City Coun. cil of ~he Ci~ty of Bre~:~erton for hee~ring and determination, which notice must-be served mailed or costed at least ten days before t~e time of said hearing. At the time of such hearing, or City Council shall proceed to examine such claim, he~r testi~uon,~ iF offered and shall make and enter an order upon the rain_utes t~'mt s~id claim,~r so much t]~ereof ~zs shall be ~eemed Just and proper, shall be'paid out ~J' the general fund. Costs of service, a~iling and posting, ahall be added to ~ny ~mount so folmd to be due and shall be collected at the same time andin the same m~nner as other chintzes under this ordinance. . SeC. 6. At ,the time when the cit~y, co.unc~il p~ays the claim for cutting ~aid weeds, as in this ordinance provided, it' shall make an order~tbat the amount paid shall be a t~x on the lands, or lots,~on wh~ich_~said work was ~one, after the exptr- ati.on of ten days from the date of en~t~r~, or~d.er~ a~n~d a?kr t~e expiration of ten days if the same is not paid the ~ay~r and the City Clerk s]Qall certify the .same to the co]mty treasurer of the comity of Kitsap to be enher~d m~on the tax rol' against said 'oroperty. ~ ' ' Sec. ?. Any interested party may a~m the ~cision' ....... and~order~ the City Co,moil of the City of ]~reraerton as pr~vid~e~_b~ law in_suc~lI e~s~s. ~ Sec. 8. This ordinance shall be i~n full force and effect five da~s from and after its ~)assage, anpro,~al and publ~ca!lon. Passed by the City Co~mcil of t~~ert~roved by~e this 10th day of April, 1916.
