AN ORDINANCE providing for the payment-of assessments against the
Municipal ,~ater System of the Oity of Bremerton by the i~suance of war-
rants on the Ourrent ~ater Fudd of the said System in accordance with judgment of
the Superior Oourt of Kitsap County, ,~ashington.
WHEREAS, in that cert~i.n cause in the Superior Court of Kitsap County,
State of ,,ashington, wherein J. H. lv~rtin a~d others are appellants, and the
City of Bremerton is Respondent, being fee No. 5R88 of the files of said
0curt, ~he Court entered a Judgment modifying the ~ssessment ~toll in
District No. 99 of said City and provided for an assessment against the
Water System of said City in the full amount deducted from said assessment
roll, in accordance with Ohapter 153 of the Session Laws of 192Z for the
State of ~,'~ashlngton; therefore,
BE IT ORDAINED BY THE COI~iLISSIONERS O~ THE CITY OF B~,[ERTON:
Se?tion 1. That the ~i~y Clerk be, and he is, hereby authorized and
directed to issue warrants against the current fund of the ~nnicipal ',¥ater
SyStem in the full amoun~ of the assessment levied a,~a_inst the said ,~ater
System ~y judgment of the ~uperior Court for Kitsap ~ounty, ~Vashington in
that certain cause wherein J. H. ~artin, et al, are appellants, and
City of Bremertonis respondent, being an appeal from the assessment ~oll
of Local Imorovement ~is~rict No. 99, which are due and delinquent,
the sum of ~3859.07 together with interest on saidassessments.
Section 2. That the Oity ~lerk be, and he is, hereby authorized and
directed to issue warrants against the current water fund of the i,~Iunicipal
Water Oystem in payment of assessment against said system in Local Improve-
~t District No. 99 as they may become due in future, together with inter-
est thereon, said war~.ants to be subsequent in payment only to bonds and
obligations of said ,~a~er System prior to the levying of said assessment.
Section 3. This Ordinance shall be in full force and effect thirty days
after its passage and publication, as provided by law.
Passed by the Oity Commission at a ~egular Session this first day of
Angust, 1923.
