~AN ORDINANCE providing for ;he protection of the water supply of the City of
Break,on,defining ~,luisanoes com~litted on the wader-shed of said supply, provid-
ing poesies for 7iola~io~ ~he~eof, and dec~a~ing an emergency~
Sec~ion~. The pas~uringof, or the ~rmi~ing of cattle, horses, mules,
h~s, shsep ore,her livestock or domestic fowls to ~un in or upon the areas
drain~ng in~o ~e lakes, rivers, s~rea~ns, sprin~s, creeks or tributaries con-
s~l~u~in~ ~he so~Ges of supply ,~f wa~er of ~he ~ity of Bremer~on for drinking
or domestic p~pose~whereby such wa~er or any par~ ~hereof in con~ami~ted,
polluted or rendered~nwholesome, or the puri~y of such ~ter or any p~
~hereof ts destroyed o~e~angered, be ~d ~he same is here~y d~clared ~o be and
cons~u~u~e a nuisa~e.
Section E~ T~ ~he e~c~ion, establishment, main~ainance, using or suffer-
ing ~he same to be done of a~2 water-closet, privy, tess-Fool, barn, hog-pen,
s~oek feeding ~rd, slaughter p~, d~mestic fowl house or coop, or the deposi~
of ~he offal of~y animal or human, or the deposit of any ~wholesome or
uncleanly s~s~ance, or the deposi~ or ~ial of ~he carcass of a~ animal, or
~he conducting of any ~iness or oe. oupation, or ~he yard~g of any fowls, or
~he ~lowing of ~y condition in or upon t he areas draining in~o the lakes,
rivers, s~reams, cree~ or tributaries constituting ~he sources of supply
water of the ~ity of ~emerton for drink~i~g or domestic purposes whereby such
wa~er or any par~ the~'eof is oon~ami~ed,-xpollu~ed or rendered unwholesome,
or ~he puri~y of such water or any p~ ~heFeof is destroyed or endangered be
and ~he s~e is hereby declared ~o be unlawful~ and ~h~~either or any of said
ac~s or ~hi~s is hereby declared ~o be and conmtitu~e a nuisance.
Sec~ion 8. Tha~ fishi~, o~ping, hunting o~x~picnieing upon any of the
areas draining in~o the la~s, rivers, s~reams, spr~ugs, c~eeks or ~ribu~aries
eons$i~u$ing ~he so~oes of supply of wa~er of ~he ~i~2 of ~Bremerton for drink-
ing or domestic p~po~es be and the sac~ is hereby dec~aye~ $o be ~law~l.
Section A. Tha~ ba~hi~ or wadi~ in any of ~he lakes., rivers, s~reams,
springs, creeks or ~ribu~aries constituting the souses of ~u~ply of wa~er of
water of the Ci~y of ~remerton ~or driving or domestic purposes is hereby
dec,red ~o be unlawful ~d p~ishable as herein~er provided.''''
Section ~. Any person vlola~i~ ~y of ~he provisions of th~ordi~nce
shall, upon conviction ~ereof, be ~unished by a fine no~ ~o ~ceed ~e H~red
Dollars or confined in the city jail for a period not exceeding ~hir~y days or
by'bo~h such fine and imprisonmen~
Section 6. In addition ~o ~he penalties hereinbefore provided, or in~Qieu
~hereof, ~h n~sance may he aba~ed as o~her nuisances are aba~ed under the
pro~isions of the laws of ~he 5~ate of ,~ashington.
Section 7. This ordinate is passed in pursuance of ~e authority vested
'in.ei~ies and ~oWns of this S~ate by Ohap~er of ~he Session Laws of 190~,
Laws of.~he ~a~e of ~ashing~on, and o~her l~ws o~ ~he S~ate of (~ashing~on.
Section 8. If any ~ar~ of this ordinance is adjudged ~o be invalid or
~oone~i~u~ional, such adjudication shall no~ affec~ ~he ordinance as a whole
or ~y section, provision or par~ thereof not adjudged invalid or unconstitutional.
Section 9. ~ emergency ~xis~s and ~his ordin~ce is necessary for ~he
i~edia~e preserv~ion of ~he health and safe~y of ~he People of ~he Oily of
Br~er~on, and shall ~ake effect i6media~ely after i~s passage and publication
as provided hy law.
