See. 1. Whenever th~ Oity Com~sion shall desig~te and establish any of a s~ree~, ~ley, avenue or public place in the city as a marke~ place, it shall be the du~y of ~he ~uperi,~tendeat of o~reet~ ~o cause the boundary of such ~rket place ~o be marked upon the grom~d and to divide such market place in~o stands not less th~ four [4) fee~ nor more taan six [6) feet wide alon~j. ~he. c~-bline or side- walk of such street, argue, alley or public place, and to cause such stands to be numbered and the numbers ~d boundaries ~he~-off to b~- plaiuly marked upon the curb, sidewalk or street. ~o person shal% Oe pe~n~i~ted to ~lock any s~reet or alley abutting on a market place wi~h cars, wa~ons, teams, b~xes or debris of any ki~ or character whatsoever. Sec. 4. I~ sh~l be unlawful ~or a.ay person ~o sell or offer for sale any ar.~iole or ~hing in any oublio market place o~her than such articles or thim~'s as are ac~.ually grown or produced by such person;'Provided, that ~he City Commission may ~lot and set aside such additional space adjaoen~ or ~oximal ~o such. market place for ~he use of ~hose not producing or :n~ufaoturing the articles or sold or offered flor sale by them, but in no case s~all the rental flor suc~ space be less ~han Five [$~) ~ollars ?er front, foot per month, Sec. 5. It' mhall be m~lawful for any person to scl% or offer for sale any of the articles or thins pe~nitted to be sold in ~y ~rket place on the firs~ day off the week, eo~nonly called Sunday, or on any other day off the week except between the ho~s of Five [5) o'clock in the fore~loon and eleven [11) o'clock in the aff~ernoon. Sec. 6. I~ shall be u~wf'ul for ~y person to fail ~o vacate ~h.e stand assiMned ~0 him upon the disposition off his goods, or when ordered so to do by a policeman, Marke~ Inspector or other duly m~thorized officer o~' the Oity having 9barge off such marke t. Sec. 7. Every~ person selling or offferRng for sale articles or thin~s in any market 91ace shall have a receptacle in which he shall deposit all ~rimmings waste ~mt~er of eve~'y kited, ~d it shall be unlawful for ~y person to throw, deposit or leave ~y waste ~tter upon ~y street or sidewalk of such market place. Sec. 8. I~ sh~l be ualaw~l for any person to ~mke any pu~blio outcry or do 'hawkin_~' or "speiling", cz' ~o ~ive ~y musical or o~her entertainment foz- the ~purpose of drawing custom or to attract attention in ~y ~rke~ place. Sec. 9. I~ sh~ll be unlaw~l ~or any perso~l to sell or offer for sale any article or thing purchased from ano~er either for cas~ or for sale on co~mnission, except as hereinbefore provided~ and no vendor of mea~s shall sell the mea~ any fowl or animal unless the same has been conti~u~ly fed or kept on the farm or place of said ve2dor foz' the followings..periods: beef, ninety (90) days; pork, mutton, ~urkey, sixty ~60) days; sucklin:~, pigs, veal, l~nb, chicke~'~s, du.o~s, geese, rabbits, ~hirty [o0) days. See. 10. It shall be u~':~lawful for any person to sell or offer for sale any article or thi~'~ on any market place except from a 'booth, table or stall, and then .only from such bosch, table or stall as may have been assigned to such person by the person havin~ such ~rke~ in charge from time ~o ~ime in such ~:~er as s~ll accord to each person eflual opporfi~i~ies End privileges for sale. No person shall be ~lowed more than one booth or stall or sell ~hru more than one e~ploy~e excep~ wi~ the consent ~d agproval of the person having charge cz suen :~rk~t. ~e~. !1. A ~harge of ~wenty-five [25) cents per day shall be ~id for ~aoh day's: occupancy of ~V stall, ~able or hooch for the purpose of defraying a portion of the cost a~d expense to the ~ifiy of ~naint~ini~' such mar~et place. The charge herein provided shall be paid to the person having charge off such marke ~ afl ~he time such b~o~h, table or stall is assigned, a~ all moneys so paid shall be paid over to the City Treasurer. Sec. 12. Vendors shall be permitted $o place signs over their booths, ~ables or stalls, with the ~:~ame sr ~rader~mrk thex'eof, the prgpr~e.t~ and charac- ter of which~ shall~ be governer by the judgmen~ of ~he person having charge of such ~rket ~place. Sec. l~. In addition to the penalties hereinafter provided for the viola- tions of the provisions he~eof~ any vendor m~y be subjected to permanent .or tem- porary expulsion from the use of any ~rket place, for selling .or offering for sale any article or thing not grawn or produced by him as required by this ordinance, an:~ the pe~'son having charge off suc~h ~arket, if he believes any person is selling or offfering for sale any ~ticle or thin~ not grown or ~ro- duced by him as required by ~his ordinance, may require such oerson ~o make affidavit before s~ne officer authorized to administer oaths that such ~ rson ~s ao~lly grawn or ~roduced ~he articles or ~hings in question, and if such person fails, neglects or ~fusss ~o make such affidavit, such reffusa% shall be conclusive evidences of ~he violation complained of, a~'~d ~hereu-~on such person may be either suspended or per~mnen~ly expelled from She use of such market by the ps~son havi~g such market in charge.
