AN ORDINANCE providing for the improvement of Fifth Street from the West margin
of Paci£ic Avenue to the East margin of Park Street, by clearing, grubbing, grading,
constructing, altering, lowering or replacing water mains and lateral sewers, providing
for drainage and construct~.ng curbs and gutters and by widening sidewalk and by paving
with a one-course concrete pavement together with any and all other work to finish the
job in a good and workmanlike manner, and So do such other and further work in connecti
therewith as is necessary to make such improvement a complete job, all in accordance
wi~h plans and specifications prepared by ~he 01fy Engineer and on file in his office
and in the ~£fice of the 0ity Clerk of the City of Bremerton, and in accordance with a
Resolution passed by the 0ity Couz~cil on the 14th day of February, A. ~., 1921, and
creating ~ocal I~provement District, No. 100, and providing ~hat payment for said im-
provement shall be mad~ by special assessment upon the'property in said district,
ab~tting upon orcontiguous or approximate to the said improvement and payable by mode
of payable by bonds.
The ~ity Council of the City of Bremerton do ordain as f~ll~ws:
Section 1. That ~ifth Street from the West margin of Pacific Avenue, te the
East targin of Park Street, be improved hy clearing, grubbing, grading, constructing,
altering, replacing or, lowering water mains and lateral sewers, providing for drainage
and constructing curbs and gutters and by widening sidewalk and paving with a one-cours~
concrete pavement together with any and all other work to finish the job in a good and
workmanlike manner, and to do such other and further work in connection therewith as
is necessary to m~ke such improvement a complete job, all in accordance with the plans
and specifications on file in the office of the City Clerk, in accordance with a
Resolution passed by the City Council o~ the 14th day of ~bruary, 1921.
Section E. That all cost and expense of said improvement, including all of said
improvement, including all necessary and ~ncidental expenses shall be borne by and
assessed against the proper~y included in the ass~ssmmn~ distrie~ hereinafter created,
in accordance with law. The City of Bremerton shall not be liable in any manner for
any portion ~f t~e cost and expense of said improvement.
See~ien $. That there is hereby created a le~eal improvement district to be called
"Local Impr~vemen~ District, No. 100", the boundaries of which district are hereby
mpecified and described as follows: Co~nencing at the northwest corner of Pacific
Avenue and ~ifth Street, thence North to the middle of block 16, plat of Bremerton;
~hence west ~o the east mar~in of Park Avenue; thence sou~h along the east margin of
Park Avenue to the center line of block l~ plat of Bremerton; thence east alon~ the
middle of block l~ to Pacific Avenue; thence north along the west margin of Pacific
Avenue to the point of beginning.
Section ~, That said cost and expense of said improvement shall be assessed
against said property included in said improvement district in proportion to area and
in accordance with ~he provisions of Section ~, Chapter 168, of the session laws of the
State of ~ashington for 191~.
Section §. Bonds bearing interes~ at the rate of seven per cent per annum, payable
~n or before l0 years from the date of issuance, shall be issued in payment of the cost
~n~ expense of said improvement, which bonds shall be redeemed by the collection of
~pecial assessments to be levied and assessed upon the property within said district
payable in eight equal installments with interest at the rate of seven per cent per
~nnm~, under the mode of payment by bonds as defined b~ law and ,ordinance of the
~ity of Bremerton.
These bonds shall be delivered to the contractor in ~he redemption of warrants on
~he local improvement district fund issued on the esti~ate of the City Engineer, or the
ORDINANCE NO. 713 CONT.
City of Bremerton, may, at its election, sell the said bonds and make such redemption
in ~ash.
Sec$ion 8. This ordinance shall be in full force and effect from five days after
its passage, approval and publication.
Passed by the City Council of the City of Bremerton, and approved by me this 14th
