HomeMy WebLinkAbout0804 0 IN N~C_ NO..__ 804. ~/I AN ORDINANCE providing for perpetual care by the city of Bremerton of lots sold in part of the replat of the N.orth half of Ivy Green Cemetery, herein des- cribed, together with lots in other part of Ivy *teen 0emetery, requiring pay- ment therefore, prohibiting sale of lots in such part herein described without such payment, providing for contract for such care, creating special fund to be known as "The 0emetery Perpetual Care Pund", providing for the investment of such fund, and the care and su~pervision of such lots. ~ BE IT ORDAINED B~ THE CITY CO~,,[ISSION OF THE CITY 0P BtlEI~{ERTON, AS POLLOWS: Section 1. That the Northeast par~ of the replat of part of Ivy Green Cemetery, more particularly described on the plat thereof as ~locks i to 9, ~ to '~l, ~6 tO ~, 8~ ~0 99, llO to lEl, lA0 to 1~8, l?E to l?&, allinclusive, shall be and hereby are set aside for perpetual care by the city o-f Oremerton, and all lots included therein shall be cared for as hereinafter provided by the city of f~remerton, perpetually. S~eCtion E. ~hat the lots included in that part of Ivy Green Cemetery, as met forth in ~ection i herein, shall be sold at such ,price as may be provided by the '~ity ~ommission, but the purchaser of each and every lot therein included shaI1 pa y to the ~i~y ~lerk in addition to the price ,of each of said lots the s.~ of One Hundred ($100) Dollars as a consideration for the perpetual care of .each and all of such lots so purchased; and no lot included in the part of the '-~replat of the N.~r~h half of Ivy Green Cemetery, as hereinbefore described, shall be sold to any purchaser or any person, and no deed thereto shall be ~iven until the said sum of One Hundred ($100) Dollars for each of said lots shall have been paid for such care. ~ec~ion S. The owner of any_lot or lots in any other part of Ivy ~reen Oemetery desiring to provide for perpetual care thereof by the city, shall pay to the 0ity dlerk t~e sum of One Hundred ~$100) Dollars for each and every of such lots so owned by him for Which he desires perpetual care, and upon such payment the city of ~remerton shall thereafter perpetually and for all time care for each and all of such lots so paid for by such party, as hereinafter provided. Section ~, The City Clerk shall provide~'~forms of contract or a special form of deed, as may be hereafter determined, wherein the city of ~remerton, Upon the consideration of One Hundred {$100) Dollars ~herefor, shall agree to perpetually care for each of such lots so purchased, as herein provided, the said contract or deed to be signed by the l~,Iayor and the City Clerk of the city of Bremerton; and such ~ayor and 0ity Olerk are hereby authroized to sign such deed or contract, as may be hereafter determined, upon ~he pa~nent of One Hundred ~$100} Dollars in addition to the i~urchase price of such lot or lots, for and in the name of the city of ~remerton, and to attach the seal of said 'city thereto. Section 6. The City Clerk shall transfer such amount so paid for perpetual c~re to the City Treasurer, and the ~mty ~reasurer is hereby authorized and directed to create a special fund to be known as the "0emetery Perpetual Care ~und, into which he shall pay and deposit the sum of One Hundred {$100) Dollars for each and every lot Sold providing for perpetual care; and the amount so deposited in said Fund sh~ll be invested in General ~Iunicipal or Local Improve- ment ~istrict ~onds, SChool District Bonds, or other ~unicipal Bonds, Railroad Bonds, or in such securities as ney be approved by the Commissio~ ~f the city of Bremerton, bearing interest at not less than five ~8%) per cent per annum, the interest thereon to be used by the city of Oremerton to pay the expenses of the perpetual care of such lots, and no part of the principal thereby created shall be used for the care of such lots. ~/ Section 6. Perpetual care, as herein used, shall mean the preparation of the ground thereon, and the supplying of fertile top soil for grass, seeding the same, care of such grass, the care and fertilizing of same, keeping the grass cut, providing suffficient water and the watering of same to keep such grass green, the planting of plants and shrubbery in such parts of said Cemetery as may be deter:nined by the City Commission, the construction and caring for the erection of such monuments as n~y be provided by the owner of such lots, the keeping of graves and vaults therein filled, the care of plants thereon, and such other care as may be_necessary to keep said lots, grave and vaults in best presentable and attractive condition, provided that no walls of cement or other m~aterial ~and no vaults shall be built of cement or other material in such part of the' replat of the North half of ~vy ~reen Cemetery, as hereinbefore described, the walls of which are above the surface of the ground, and no monuments or markers shall be ~laaed thereon other than marble or other indestructible material, and all markers, (exce~t'l monuments, ~hall be of uniform size and character,./, SEction ?. The city of ~remerton shall provide a record for all lots sold in the,repla~ of ~he North half of Ivy Green Oemetery, together with the accurate record of all lots in the other part of Ivy Green Cemetery for which ~oerpetual is provided, as herein c~ntained. Section ~ The direct supervision and care .of the replat of the North half of Ivy Green emetery, together with such other lots as may be provided for per- petual c~re, shall be under ~he supervision of such Commissioner as the City Oommissi~n may'direct, and the go~d faith of the ~i~y of Sremerton is hereby Perpetually~p~edged forever and during its existence as~a munic~oallty, either under its present name or any such name as may hereafter be adopted, for the care- ful c~mre, upkeep and maintenance of roll such lots provided for perpetual care in said Ivy Green Cemetery.
