BE IT OitDAIiIED B~ THE CI'l~ <~01~ISSI0i~i~S OF THE CI~ 0]~~ Section 1. It shall be unlawful for any person t~o sell, e~change, or deliver, offfer )r expose for sale or have in his poss~ssl0n with intent to sell )r deliver within the City of Oremerton, (1} ~y wnwholesome milk or cream; or (2) an~ milk o0n~aining les~ than 8,50~ of milk solids, exclusive of fats, or less than of fa~s, exce,pt in the' manner and under the conditions prescribed f~r the sale of skimmed milk~ or ~) ~y ski~ed milk, except' under the n~e of "skimaed milk" ~d in c~s or othe~ receptacles plainly stamped or ~rked in some place ~th the words,"Ski~ed ~.lilk"; ~d every -person who shall serve or sell or keep for male or fo~'' the p~=p~se of-servi, ng in ~y hotel, restaurant or boarding house, any ski~.~ned milk, shall display in a conspicuous place in the room where ~he same is sold or served a placard bearing the words in large letters, ~[ILK SOLD i{Ei~E"; or (4) ~y cream containiz~ less th~ 18% of fats~. Section Z. It shall be ~wful f~r~ ~y pers~on, firm or c)r.)ora~ion to sell, offer for sale or have in his or its possession for the p~p0se o~ sale or ~istri- bution in the City ~f Bl-e~erton ~y milk or cream which has n)t been produced from a cow or cows which have within o..e year prior thereto been subjected to a subcu- taneous )r intradermal injection of tuberoolin in the ~mnner a.t~)?roved by a ~e~er~rian ~f t]'~ U~ited S~a~es ~eau ~f ~imal Industry or by any licensed veternary surgeon of tho S'tate of Washington and havin~ been found ~1o be free fr~m ~u'bereulosis. Section ~. i¥~ilk or ore~n s~ll be deemed ~o be unwhole~;ome in t[~e following' cases: 1. ,~hen any foreign substance has been added ~here~o e~'plaeed' ~hez'ein for ~he purp-~se ~f thickaning, ~olori~ ~r preserving ~he same; or 2.~ ~'l~hen it ~ains any pathogenic bacaterim ~r germs, puss c-ells or blood cells; or 3. i~ cm'~ains m~re ~h~ 200,000 bacteria or germs of all kinds ~o the cubic centi- meter; or 4. ,~hen any wa~er has been added ~hereto; or 5. ,~hen any par~ of' has been ~awn from a ~ow fed on refuse or ~wheles~m~ food; or 6. ,~ben any ~rt of it has 'been drawn from ~ unhealthy or dirty cow or a cow kept in an uncle~ shed or has been milked by una-le~ milkers; or 1,~hen any p~rt of it has been c~n~in~ed; or 8. YVhen any par~ ~f it has been ~posed ,to any oonta~'ious or infec~ious disease; or 9. ,~hen ~y par~ of i~ has been drawn from a cow within ~en d~s before or five days after par~i~ion ~r in ~y case before such c~w is free from fever. Section 4. Ski.;~ed milk is hereby defined ~o be any wholesome ~ilk from which ~he cream ~s been removed or whioh conta~s less ~han 3.25~' of bu~er fat ~d 8.80~ of milk solids, exclusive of milk fats. Section 5. It sh~l be unlawful for any person to sell or deliver, offer or expose for sale ~r have in his possession with intent ~o sell or deliver any milk or ore~ in the Gity of Bremer~on without having ~ permit so to do, duly issued by ~he Gity Clerk off said ci~y or without having such pez'~it displayed in a a~nspicu~us manner in his place of b~iness or with~ut havin~ the n~ber such permit and the n~ne of the o~er thereof printed in a conspicuous manner ~n bo.th sides of every wagon or other vehicle ~ed for the sale or handling of milk or or,am. Section 6. ~pplicatia~ f~r l~rmits sha~ be made in writing and shall state She aame of the applicant, the location of his place of business, the nmnber of eows, if any, o~ed or controlled by such applicant, the location of any dairy or dairies .other ~h~ his own frown which he sec'ures and prolapses ~o sell ~nilk, the n~ber and description of a~ w~gons or o~her vehicles ~o ~e used by ag~licant in his business; and no permit ~hall be granted ~o said applicant by said ~ity Olerk if ~e is the owner of any cow or cows ~less'sald ap~licant .shall submit ~o ~he ~id Oily ~lerk a oer~fflcate showing ~at said c~w or cows have been subjected ~o a ~bereolin ~es~ as hereinbefore speo~ied and ffo~md free ~ff diocese; nor to may dairy or person, firm ~r ~orporation ~il such dairy, firm or tiofl s~ll sub~t ~o said Gi~y ~lerk ~ cer~ifi~ate showin~ that all cows handled, sold or in the~ssession of said dairy, person, firm or corporation from which said ~nilk is derived have been subjected ~o tuberoolin ~es~s as here~before specified ~d ~owing tha~ all such aows are free from ~uberculosis and in all cases such ap~lic~an~ shall further certify that the stables or barns in which such cows are fed and t~e wa~er supply .~nd the apparatus and a.opliances used or to be used by said applicant in caring for, gathering or distributing the milk or cream are in a clean and sanitary condition and the food upon which said cows are fed is clean and wholesome and theft said cows are in a heal~hy co~'~dition, free from dis- ease. $~ch permit shall be issued to said applicant in compliance with the pro- visions of this ordinance upon the paymen~ .~f the sum of ~l and shall remain in force until the 31s~ day off ~ecember following. The said 0i~y Olerk shall revoke any permi~ so issued upon t~e failure or re£usal off the holder ~hereof or from any person from whom he is ob~aini~ milk or cream for sale in said city to comply with the provisions of ~his ordinaz~ce or the laws o£ the ~$ate of ,Vashington rela~- lng to ~he sale of milk ,or cream. Section 7. I~ sh~l be unlawful for ~y person, firm, or corporation to sell milk or cre~n or offfer it for sale in ~y booth, s~d or store or market place ~ ~he 0i~y of Brother,on without first comglying with the provisio~ of this ordinan and registering his n~ne and place of business in a book kep~ by the Oity ¢lerk for ~hat p~pose. It sha~ be ~lawful for ~y ~..e~ailer or wholesale dealer in milk in the 0ity of ~remerton to se~, offer or expose.ffo~ sale any milk or cream, unl-ess ~he s~'ne shall have been furnished b~ him from a dairy or dairies which have complied with the provisions of this ordinaries and whenever any milk or cream kept, offered or exposed for s~e in said cit~: is found by any duly authorized represent- ative of said city, employed for ~at pur?ose, to be in any ~wholesome condition or which ~s 'been produced or handled i[ta maker in violation of this 3rdi~nce, he ~my condemn ~d destroy the same or cause ~he same ~.o be disposed of f3r pur- poses other th~ For h~'n~ food. Ail bo~les tn which milk or cream is distributed shall be washed clean a~x~ s~er- iltzed ir~m~edla~e~ before they are used ~d sealed fin~aediately ~er they are filled. Further it ~all be u~awful for ~y person to use milk receptacles for any o~her p~pose ~han for handli~t~ ;nilk. Section S. !~ shall be unlawful flor a~ person to sell milk or cre~a at retail in the dity of Bre:ner~on in any ,nanner w[~tsoever ~cepO in glass bottles or othe~~ receptacles securely sealed, which milk or ore~n shall be hog,led or placed in said receptacles at ~e dairy where i~ is produced or a~ a milk depot, s~o~e room or o~her pl~e kep~ exclusively for s~oring gnd h~dling milk a~ main- ~ained in a cleanly and s~i~ary oondi~io~. In no case s~l[ milk or cream oog~led in the wagon or vehicle in which it is being conveyed or from which it is being distributed; Provided however that this section is not in~ended ~o prohibit resistants, hotezs,, or bendix' houses ffrom serving milk or area;n to guests in any o~her ~mnner. However, nothing in this ordim~oe shall ~e co~mtrued to prohibit any pasteurizing plant or dairy from handling milk set,led and sealed in any other milk plant or pr.odueing dairy oom- plyi~ with the provisio~ oi' this Section 10. The s~e of milk or cream at re,ail is hereby deffined to be the sate of milk or cream of one gallon or l~us. Section ll. ~y person, firm or coroo~'a~ion ob~ainir~ any per~it from the City of Bre,nerOon as here~ ~rovided shall ~>ermit a duly authorized i~Pector said ~i~y of Bremer~on and said inspoctor shall 'Os authorized to inspect the c>ws, s~ables, drai~ge, ventilation, food, wa~er, yards, past~e, me,hods of milking ~d all other ~na~mr connected with the care and ta~agement of such dairy. Also ~o inspec~ ~l pails and vessels in or fr~o~n which milk or cre~ is sold, offfered or oH n x os (co 'dl .... .5!] exposed for sale, kept, stored or delivered ,or disposed of, includia~' restaurants, ho~els, and boarding houses and all vessels, c~s, receptacles, rofr~gorat>rs, oor~lpartmonts of any stero, buildin~ or o~h~r pl?co used in storing, handling, delivering or disposing of milk or cream ir~ ~ho ~i~y of ~ro~norton ~,3 ascertain whether ghe provisions ,of ~his 3rdirianao are bsi~ oorn~pliod with and report to the Oi~y ~o~niss~Dn 3f said ci~y any violation thee-eof, In order ~o make such inspection he shall have the ri~t to enter and shall have free access to any ~uil'~in~, establishment, vehicle or place where such milk is oroduced, be~g ~ranspor~ed, s~ored and k~pt or offered for ~ale and he shall have the right ~o take s~u?les of milk or cream therefrom in quantities not to exceed one q~r~ each for the p~pose of inspecting, testing or analysin~ the same. Section 12. No~hing in this ordinance shall be construed to prohibit the sale of wha~ is co,aaonly known as but~er milk, provided ~he s~ne is produced from pure, healthful, wholesome, and unimfected m~lk a~l handled in the m~ner herein pre- scribed for whole milk. Section 1J. ~y person, firm or corgoration violating ~y provisioa of this ordinance shall, upon oonviotimOn thereof, be fined in any sum not exceedi,g $100, or imprisoned ~ the City jail for a period not exceeding thirty days, or by both such fine ~d im?risonment. Section 14. All ordinances ~d parts.of ordinances in conflic~ herewith be and the s~e ~'e hereby repealed. Section 15. This ordinance sha~ be in full force and effec~ thirty days a~er its passage ~d~.publication as provided by law.
