HomeMy WebLinkAbout0827 ORDINANCE N0. 827 AN ORDINANCE providing for the improvement of i~arren Avenue from center of Evelyn Street to approximately the middle of the block, between l~lph Street and Nelson Street by clearing, grubbing and constructing a combined storm and sanitary Lateral Sewer of necessary size, with inlets, catchbasins and man holes, and providin for drainage and grading thereof, together with any and all other work necessary to finish the job in a good and workmanlike manner, and to do sach other and further work in connection therewith as is necessary to make such ira~>Fovementa complete job, all in accordance with plans and specifications to be placed on file in the office of the City Clerk of the City of Bramerton, and all in accordance with a resolution passed by ~he City 00mmission of the 0ity of Breraerton on ~he 9th day of September, 1925, creating a local improvement district therefore, providing for the assessmen~ 0£ the proper~y in said district, and providing for the paymen~ thereof, and pro- viding for the improvement to be made by special assessment on the property in said district, and payable by mo~e of payment by bonds. BE IT ORDAINED BT THE CITY 00I&iISSION 03~ THE CITY 0P BRF~¥~RTON: Section 1. That Warren Avenue from center of Evelyn Street to approximately the middle of the block, between ~alph Street and Nelson Street be improved by clearing, grubbing and constructing a combined storm and sanitary Lateral Sewer of necessary size, with inlets, catch basins and man holes, and providing for drain- age and grading thereof, together with any and all other work necessary to finish the job in a good and workmanlike manner, and to do such other and further work in connection therewith as is necessary to make such improvement a complete job; all in accordance with plans and specifications to be placed on file in the office of the City Clerk of t~e City of Bremerton, and all in accordance with the resolution passed by the City Cormnission o£'the City of Bremerton on the 9th day of September, 19~[. Section 2. That the entire cost s~d expense of said improvement, including all neoessa-r.y and incidental expenses, shall be borne by and assessed against the property included in the assessment district hereinafter created, in accordance with law. The City of Bre~:~erton shall not be liable in any manner for the cost and eEpenses of said improvement. Section 3. That there is hereb~,~ established and created a Local Improvement District to be ca,lled "Local Improvement District No. 109", the boundaries of which dis~ric~ are hereby specified and described as follows: Beginning at a poin~ on the center line of Evelyn St. 30 feet .south of the southwest corner of block l, Central :~ddition; Thence east 137.47 fee~ along cen- ter line of Evelyn S~. Thence north to a point on the north line of tract 8, block ~, Warren Smith's Acre Tracts, said point being 16g.06 feet east of the center line of r/arren Ave. Thence west to a point on the north line of tract Z, block 6, i~arren Smith's Acre Tracts, said point being 168.31 feet west of the center line of Narren Ave. Thence south to the center line of Evelyn ~t. ~'hence east along the center line of Evelyn St. 168.72 feet to the center line of Warren Ave. Thence north along the center line of ~?arren 2~ve. 2.~0 feet. Thence east ZO feet to point o£ beginning. Section 4. That the said costs and expenses of said improvement shall be assessed against said property included in such iraprovement district in proportion to area and in accordance with the pro*isions of Section Two (2~ Ohapter One hundred Sixty Eight (168) of the Session Laws of the State of Washing ;on for 1915, and as may be ac. ended thereafter. Section ~. Bonds bearing interest at the rate o~' seven (7) per cent, per annum, payable on or before l0 years from date~ of issuance shall be issued in pa~nent of the cost and ex~pense of said improvement, which bonds shall be redeemed by the coll- ection of special assessments to be levied and assessed upon the property in said district, payable in eight equal annual installments with interest at the rate of seven per cent. per annum, under the mode of payment as defined by law and the ord- inances of the City of Bremerton. These bonds shall br~ delivered to the contractor in redemption of warrants on the Local Improvement District ~und on the estimate ~f the City Engineer, or the City of Breznerton may, at its election, sell said bonds and make such redemption in cash. Section 6. This ordinance shall be in full force and effect frown and after i~s passage and publication as provided by law. 113 " PASSED by the 0ITY CO~ISSION, signed by the ~ayor, and attested by the City Clerk in authen~icationof such passage this lath day of October A. D., 1925. Attest: 1,~ayor. This Ordinance introduced and had its first reading at a regular meeting of the City Gommission on the 7th day of October, 1925, and placed on file with the City Clerk on said 7th day of October, 1925, for public inspection.
