AN ORDIN~NCE providing for the improvement of ttayward ~tvenue from its in-
intersectioi~ with the north ~_:oundary of East iIinth Street to the South bound-
ary of East Thirteenth Street, and Perry Avenue from its intersection with
East l~intl~ t'o t~e South boundary of East Eleventh Street by clearing, grubbing~
and!?~'grading, the construction of :five foot concrete w~:~.lks on each side of
s~id avenues within ~he limits proposed to be i~proved, the construction off
concrete.curbs and gutters along Hayward ,Avenue within the limits pro~osed to
be improved, a~.nd the construction of a ~rotecting curb in connection with the
side walks along Perry .Avenue, within the li~uits ]?ro~osed to be i~proved,
providing for atll excess dra~inage and the adjustment of water mains a.~ad sewers,
and the improvement of East Ninth 3treet from Perry Avenue to ~'.tla~vard Ave~e
by providing for drain~tge ~hereof, together witt'~. ~he doing of any and all
o~her work necess~.ry to finish the job in a workmanlike manner, and together
wi~h such other and further work in connectio~'~ ~herewith as may be necessary
~o m~ke such im~?rove.:~ent a complete job, all in accordance with the Resolution
passed by the City Comission on the 25rd d~-~y of September, 1931, and creating
Loc:.~l Improvement District No. 125, and providing that paym~ent for such
improve~-~ent shall be made by speci~l asse~sments upon the pro~erty in said
distric~ abutting upon or contiguous or proximate to the s~-~id i,~provement and
payable by ~uode of pa3w~ent by bonds.

Section 1. That Hayward Avenue from its int~rsection wi~h the north boundary
of East Ninth Stree~ to tl~e south boundary of Eas~ Thirteenth Street, and
Perry Avenue from its .intersection with East Ninth Street to the south boundary
of Eas~ Eleventh Stree~ by clearing, Grubbing a~'~d grading, the construction of
five foo~ concrete w~lks o~'~ each side of sa. id ave,~,ue~.: withi~ t[~e li~its proposed
~o be L~l~roved, the constructi.:~.~ of concre~:e curbs and gutters along Hayward
Avenue wi~hir~ the limits proposed to be improved, and the construction of a
pro,coting curb in connection wi~h ~he side walks along Perry Avenue, within
the limit: proposed to be improved, providing for all excess drainage and
~he adjustment of water mains atnd sewers, and. the i,~porve::~ent of East Ninth
Street from ]~erry Avenue to HaFward .,'~venue [:y ,~.,roviding for drainage thereof,
together with such other and fu~rtt~er work in connecti.Ji"l therewith as may be
necessary to make such iml:rovement a c::mplete job.
Section 2. Tha~ all cos~ and expense of said i?,~prove~en~, includi~g ~:.ll
necessary ~%nd incidental expenses, shall be borne b. and assessed aga~..ins~
~he property included in the assessment dis::rict ~:~.ereinafter created, i~-~
accord~_~nce.with the law, and equal assessments shall be pl~:~.oed against the
pffoper~y owned by .the .oi~y: in~.eai~d assessment district so crea~ed as is placed agai~
other property in 'said district, and the City of Bremer~on shall be liable for the
assessments placed upon said city proper~y, but shall no~ be liable for any o~her
portion of the cos~ and expense of said improvement.

Dis~ric~ to be called "Local Improvemen~ Distric~ i,~0. 125" 2he bo~mdaries off which

Section 4. Tha~ ~he costs ~nd expenses of s~id improvemen~ shall ~e assesse~
ag~ins~ said property included in said im~rovement district in proportion
and i_'; ,~,~'~;~e wi~h the provisio~s of Section 2, Chapter 188 of the ~essmon
~ws of ~he Sta~e off Washington for 1915.
See~i0n 5. Bonds bearing in~erest ~t the ra:re off 7% per:a~, payable
or before ~en (10) years from the date of issuance shall be is~ued In pa~ent
~he costs and ~xpenses of said improvement, which bonds shall be redeemed by ~he
collection of special asses~ments ~o be levied and .~s~es~ed upon the proper~y
within ~he said district, payable in eigh~ equal a~mual insta~llmen~s with inter-
est a~ the r~,~e of 7~per ann~ under the mode of paymen~ by bonds as defi~md by
law and the ordinances of ~he City of ~remer~on; ~hese bonds shall 'o~ de.littered
~he con~r~-~ctor in,he redemp~i'~n off warrants on the Local lmpro:~emen~ Di~-~trict
issued on the estimate si' the City Engineer, or the City of Breme~'~on may at its
election, sell the s~:~,id bonds and make such redemption in cash.
Section 6. This ordin~tnce shall be in full force and effect ~ir~y days
~rom and a~'~er i~s passage and pu'blication as provided by law.
