AN ORDINANCE rela~ing ~o an~regula~ing the production, sale and ~is~ribution
of milk and milk produc~s in the Oity of B~emer~on, adooting the definitions
of terms and sSandards of ~ of such milk and milk products, of
requirements of cleanliness of the premises, s~ables and plants where
produced or prepared, and all provisions and requiremen~s rela~ing ~here~o
of the laws of the State of Washington as ~o milk and milk produc~s sold
within the ~i~y of B remerton; prohibiting ~he sale of milk and milk
products in ~he Oi~y of Bremer~on produced, prepared or sold in violation
of such prowisions; requiring a permit for each creamery or pas~uriza~'ion
plan~; providing for ~he licensing of milk delivery ~rucks; providing for
inspection cf creameries and pasturization plan~s; requiring ~he pasturization
of milk sold in the City of Bremer~on in plants located in the City of
Bremer~on, or wi~hin a radius of two miles of the Ci~y of Bremerton, and
providing penalties for violation ~hereof, and repealing all ordinances
and par~s of ordinances in conflict herewith.
BE IT ORDAIi~D BY THE OI~i~f CO~ISSIOE OP THE CITY O~ B~RTON, ~s follows:
8ee~ion 1. Tha~ all provisions of the laws of ~he S~e of ~Vashing~on
rela~ing ~o ~nd regulating the production, sale and dis~ribu$ion of ~ilk
and milk produc~s, inoluding the defini~ions of ~erms relative ~here~o, ~he
s~andards of quality of such milk and mil~ products, or requirements of cleanliness
of ~he premises, s~ables and plan~s where produced, prepared or ho~!ed and
provisions and requiremen~s rela~ing ~here~o and ~o ~he produc~ion of milk and
milk produo~s are required by ~he lmws of ~he SSafie of ~ashing~on, or as ~he same
may hereaf~er be amended, be and ~he same are hereby adopted ~s ghe s~andards
of quali~y and requirements for the production, sale and dis~ribu~ion of mll milk
and milk produo~s sold or offered for sale in ~he Gi~y of Bremer~on, and ~he
sale er offer of sate by any person, f~ or corporation of any milk or milk
produe~s produced, prepared, bo~led or handled ~der conditions no~ in
compliance wi~h such laws or in violation ~hereof be and ~he same is hereby
prohibited.
See~ion ~. I~ shall be ~lawful for any person, f~m or corporation to
main~ain ~r operate a creamery or pas~uriza~ion plan~ in the City of Bremerton
or ~o sell or deliver milk from any such plmn~ wi~hou~ firs~ taking ou~ a permi~
so ~o de, which pe~i~ shall~be issued by ghe City Clerk ~pon a form pre.red
~er ~ha~ p~pose, which permi~ shall n~me the owner of such plan~, nmme i~s
loe~ion, ~nd ~he p~oduc~S proposed ~o be sold, and ~he appliean~ shall pay ~he
s~ of $10.00 each year ~herefore, and such permit shall expire on ~he firs~
~ay ef ~uly of each year.
Section S. I~ shall be unlawful for any person, firm or corporation to deliver
milk in ~he City of Bremer~on in ~rucks or other vehicles ~. thou~ first obtaining
~ license for each of such ~rucks or vehicles, which license shall be issued by
~he Gi~y Clerk ~pon p~en~ by ~he applican~ of ~.00 i~or e~ch ~on cap.city of
each of such ~rucks o~ vehicles or f~ac~ion~l part thereof, which license shall
be of me~al, shall specify the year of i~s issuance ~nd expire on ~he 1st day
of July of each year. Such license shell be securely ~ached ~o the vehicle
for which i~ is obtained.
Section ~. The City Co~ission shall ~ppoin~ the City Health Officer or
o~her person ~s }~ilk Inspector and it sh~ll be the du~y of such ]~ilk Inspector
~ such times ~s i~ may be necessary, or expedient, ~nd a~ least once every s~
months ~o inspec~ all creameries, p~s~uriza~ion plan~s, and other plan~s where
milk is pas~urized, prepared or bo~led for sale within ~he City of Bremer~on, and
said L[itk Inspector is further ~uthorized to inspee~ the premises, dairy s~bles,
buildings, e~c., which milk or milk produc~s are produced, prepared, or offered
for sale, or sold, within ~he City of Bremer~on, and ~o re~]uire ~he owner ~hereof
~o comply with all ~he provisions of the laws of ~he S~a~e of ~Vashing~on ~tnd ~his
ordinance relative ~here~o.
Section 5. I~ shall be ~lawful f~y person, firm, association or
j'~pora~ion to bring ill~O Or rqo~Ve~ ~he Ci~y of Bremer~on for salle or to sell
~:~' offer for s~le~herein 0r.~ ~ ~-~~ on h~nd therein for sale ~ny pas~urized
~ ~g radi~s of ~wo miles of ~he City of Bremer~on.

~f ~his ordingnce shall, upon conviction ~hereof, be punished by a fine of no~
~o exceed $100.00 or by impriso~en~ For a period no~ ~o exceed ~hir~y ~80) days
or by both such fine and in~priso~nent.
Section 7. All ordinances and pgr~ of Ordina, noes in oonflic~ herewith be and
~he same are hereby repealed.
~ec~ion 8. If any par~ of ~his Ordinance is declared invalid or ~cons~i~u~ional
~e same shall no~ mffec~ ~he remaining sections or par~s of ~his Ordinance.
Section 9. This ~dinanoe shmll be in full force and effeo~ thirty (SO) days fro~
amd mf~er i~s passage and publication a,s provided by law.
