AN ORDINANCE declaring the intention of the City Commissioners of the City of
Bremerton to bring condemnation proceedings, under the eminent domain act and laws
of the State of Washington to secure title to the NE±4 of the SE~ section 38, Twp.24
N.R.1 W.W.M., for the reason that the same is in the water shed the run off of which
furnishes water to the City of Bremerton; directing the City Attoruey to bring con-
demnation proceedings to accomplish this end, and declaring an emergency herein.
BE IT ORDAINED BY THE CITY C0t~;~..~ISSIONERS 0F THE CITY OF BRElv~RT0~:
Section 1, That the City of Bremerton, Kitsap County, State of Washington,
owns, controls and operates its water system, furnishing water to the municipal
corporation, the City of Bremerton. That in order to secure water for domestic and
other purposes, the said city has purchased large tracts of land lying within the
water shed, the drainage of which furnishes the supply of water for said corporation;
that the NE~ of the SE~- of Sec. 36, T~. 24 N.R.1 W.W.M. belongs to one T. G.
Kindred and wife of 2605 Burwell Street, Bremerton, Washington. That this tract
lies within the said water-shed and the said Kindred is threatening to improve this
tract of land, by selling sm~l tracts so that dwellings may be erected thereon.
Section 2. That the said T. G. Kindred purchased this tract of land for ~400.00
and has not materially improved the same, and the City Co~issioners, above mentioned
have offered the said o~er the s~ of $600.00 for the same, but the said o~ers
hold this property at the exorbitant price of $4,000.00
Section 3. That it is vitally necessary that the City of Bremerton o~is
tract of land so as to prevent the pollution of the water supply, above mentioned,
and if the s~e is improved by individuals, great d~ger will result to the water
supply of said city by reason of .pollution.
Section 4. NOW, T~REFORE, it is hereby ordered that the City Attorney for the
C{ty of Bremerton be, and he is hereby directed, to bring proper condemnation pro-
ceedings in order to secure the title of this land For said city.
That an emergency exists for the passage and taking effect of this ordinance,
to p~eVent pollution of the waters, as aforesaid, therefore the said City Co~ission
hereby declares that an emergency exists in this matter and that this ordinance shall
he in full force and effect upon the passage of this ordinance and 'the publication
thereof as provided by law in.one i.ssue of the official paper of the City of
Bremerton. .
