HomeMy WebLinkAbout1545 AN ORDINANCE relating to the filing of claims for damages against the City
of Bremerton, and establishing the form and contents thereof and the procedure
upon such claims.
THE CITY OF BREMERTON DOES ORDAIN:
Section 1. All claims for damages against the City of Bremerton must be
presented to the City Council and filed with the City Clerk within thirty (30)
days after the time when such claim for damages accrued: Provided that if the
claimant shall be incapacitated from verifying and filing his claim f or damages
within said thirty days, or .if the claimant be a minor, then the claim may be
verified and presented on b~half of said claimant by any relative, or attorney,
or agent representing the injured person.
Section 2. No Ordinance or resolution shall be passed allowing such claim,
or any part thereof, or appropriating any money or other property to pay or satis-
fy~the same or any part thereof, until such claim has first been referred to the
proper department or committee, nor until such department or committee has made
its report to the Council thereon pursuant to such reference.
Section 3. All such claims for damages must accurately locate and describe
the defect or negligence that caused the injury or damage, reasonably describe the
injury or damage and state the time when the same occurred, give the residence for
six months last past of the claimant, contain the items of damages claimed, and
be sworn to by the claimant, or a relative, attorney, or agent of claimant.
No action shall be maintained against the City of Bremerton for any claim for
damages until the same has been presented to the Council and sixty days have
elapsed after such presentation.
Section 4. All such claims for damages must contain the statement of
actual residence of claimant, by street and number at the time of presenting
and filing such claim.
Section 5. This ordinance shall take effect thirty (30) days following
final passage and publication.
APPROVED on first reading this 22nd day of September 1943, by the City
Council of the City of Bremerton.
PASSED on final reading, signed by the Mayor and attested by the City Clerk
in authentication of such passage, this 29th day of September 1943.
