AH ORDINANCE granting an easement to the Housing Authority of the City of
Bremerton.
THE CITY_ OF BRE~:~TOV. DOES ORDAIN:
Section 1. That the City of Bremerton, Washington, a municipal corporation,
for a valuable consideration, hereby conveys and grants unto the Housing A~.~thor-
ity of the City of Bre~nerton, Washington, a body politic and corporate, its
heirs, successors and ~ss~gns, an easement for a period of ten years from date
across the ~o!lowlng described p~operty in Kitsap County, Washlnston:
A forty (~0) foot strip of land twenty (80) feet
of which lies on either side of the following
described center llne:
Beginning at a point on the sout~ line of Section
91, Township 94 ::orth, Range 1 East, W.L~., V~ich
is 0.2S feet North ~d S4~.eS feet West of the
South ouarter corner of said Section 21; thence
South ~0°4~'S0'' East 80.91 feet; thence South 25°
~7'00" West 107.!0 feet; 'thence South 10008'20" West
S~7.18 feet; thence South ~°40'10" West [~99.6~ feet;
the~ce South ~2°4~'10'' West 249.80 feet; thence South
4~°~'40'' West ~4 e2 feet; thence South l°24'00" West
~99.00 feet to the point of discharge into Charleston
Creek;
for the lay~%ng, maintaining and keeping in repair of a storm sewer pipeline across
said property; ~d the Grantor hereby grants to the Grantee, its heirs, successors
and assigns, the right to o!as.r said property, to go upon the a~ove described
property whenever reasonably necessary, and to break the gro~d thereof, for the
purpose of laying, maintaining or repairing said pepel~ne.
Section 2. Any and all ground broken or streets exca,~ated or pavement
broken in connection ~th the laying, maintaining and repa~fng of said sto~
sewer pipeline, shall be restored to the s~e, or as good, condition as ~t was
prior to s~ch brea~ing or excavation, and the said Housing Authority shall
save the City of Bremerton ha~less from any and all claims for damages or in-
juries of every kind, nature and description, directly or indirectly resulting
out of the laying, maintsining or repairing of such sto~ sewer pipeli~e or the
use of the above described property by said Authority. The Housi}~g ~luthority
of the City of Bremerton shall comply ~ th all ressonable requests, rules and
regulatio~s now in effect or hereafter promulgated by the City of Bremerton
relating to the City water shed.
APV~ROVED ~animously by the City Council of the City of Bremerton on first
reading this 2!st day of April, 194S.
PASSED ~n~_imously by the City Council of the C~ty of Bremerton on final
reading, signed by the ~ayor and attested by the City Clerk in authentication of
