AN ORDINANCE granting the Housing Authority of the City of Bremerton the
right to lay, maintain and keep in repair, sewer pipe under certain city street~
avenues and alleys in the City of Bremerton.
THE CITY COMMISSION OF THE CITY OF BRF~IERTON DOES ORDAIN AS FOLLOWS:
Section 1. The City of Bremerton does hereby grant to the Housing Authorit
of the City of Bremerton the right to lay, maintain and keep in repair sewer piI
under the streets, avenues and alleys in the City of Bremerton, over the parti-
cular route hereinafter described, and to excavate the city streets along the
said route, for the purpose of laying, maintaining and repairing said sewer pipe
Beginning at a point where the centerline of Oyster Bay
Avenue intersects the ditch line on the south side of
State Road No. 21, and running thence Easterly along
said ditch line on the south side of State Road No. E1
to its intersection with the City Limits on the center-
line of Ninth Street.
Thence beginning again where the centerline of Charlotte
Avenue intersects the ditch line on the south margin of
State Road No. 21 and following said ditch line along the
south side of State ~oad No. 21 Northeasterly to its
intersection with the City Limits at Eleventh Street.
Thence beginning again five (5) feet south of a point
where the East margin of Terrell Avenue intersects the
City Limits; thence East along a line which is five (5) feet
South of and parallel to the City Limits to its intersection
with the centerltne of the alley midway between Wycoff
Avenue and Callow Avenue, said point being the present
termination of the West Bremerton Storm Sewer.
Beginning five (5) feet East of a point where the West
margin of Oyster Bay Avenue intersects the south margin of
State Road No. 21; thence North along a line five (5)
feet East of and parallel to the West margin of Oyster Bay
Avenue, to the Government ~leander line.
Beginning at a point 12 feet West of the intersection of
the South margin of Farragut Street and the centerline of
Callow Avenue; thence South 12 feet West of and parallel to
the centerline of Callow Avenue to a point 20 feet below
extreme low water in Sinclair Inlet, in Kitsap County,
State of Washington.
Section 2. Any and all streets excavated or pavement broken in connection
with such laying, maintaining and repairing of sewer pipe, shall be restored to
the same, or as good, condition as the same was prior to such breaking or
excavation and the said Housing Authority shall save the City of Bremerton harm-
less from any and all claims for damages or injuries of every kind, nature and
description directly or indirectly, resulting out of the laying, maintaining or
repairing of such sewer pipe.
Section 3. This ordinance shall be published in one issue of the official
newspaper of the City of Bremerton immediately following its introduction and
Ordinance No. 1351 (cont)
first reading, and shall be brought before the City Commission of the City of
Bremerton on final reading ~ the regular meeting of the Commission on November
27 , 1940.
Section 4. This ordinance is necessary for the immediate preservation of
the health and safety of the inhabitants of theCity of Bremerton and for nationa
defense, and shall take effect immediately upon final passage and Dubltcation.
INTRODUCED AND APPROVED by the City Commission of the City of Bremerton on
first reading, this 23rd day of October, 1940.
