AN ORDINANCE providing for perpetual care by the City of Bremerton of lots sold
in part of the replat of Ivy Green Cemetery requiring a payEent therefor, prohibit-
ing the sale of lots in such part herein described without such payment, providing
for contract for such, and the care and superv'~sion of such lots.
THE CITY CO~_~MIS$ION OF THE CITY OF BRENERTON 0RDAI!',IS AS FOLLOWS:
Section 1. That the part of the replat of part of Ivy Green Cemetery more
particularly described in the plan there-of known as Ivy Green Cemetery Perpetual
Care No. 2, except Block 1 thereof, shall be and the same is hereby set aside for
perpetual care by the City of Bremerton and all lots included therein shall be cared
for, as hereinafter provided, by the ~ity of Bremerton in perpetuity.
Section ~. That the lots included in that part of Ivy Creen Cemetery as set
forth in Section 1 herein, shall be sold. at such price as may be provided by the
City Commission of the City of Bremerton but the purchaser of each lot therein
included shall pay to the City Clerk in a~dition to the price of each of sai~ lots,
!Bhe sum of ~100.00 per lot for the perpetual care of each lot so purchased and no
lot included in the plat of Ivy Green Cemetery Perpetual Care No.~, except Block 1
thereof, shall be sold to any purchaser or any person and no deed thereto shall be
given until the said sum of $100.O0 for each of said lots shall have been paid for
such care.
Section 3. The City Clerk shall provide forms of contract or such form of deed
as may hereafter be determined wherein the City of Bremerton, in consideration of
$100.00 therefor, shall agree to perpetually care for each of such lots so purchased
as herein provided and the contract or deed shall be signed by the ]'~yor a~d the
City Clerk upon the pay~nent of $100.O0 in addition to the purchase price of such
lot or lots.
Section 4. "Perpetual care" as use~ herein shall mean the preparation of the
ground and the supplying of fertile top soil for grass, seeding the same, the care
and fertilization thereof including keeping the grass cut, providing sufficient
water to keep such grass green, plantin~£ of plants and shrubbery in such parts of
said cemetery as may be determined by the City Commission and construction an~ caring
for the erection of such monuments as may be provided by the owner of such lots,
the keeping of graves and va~lts therein filled, the care of plants thereon an~ such
other care as ~ay be necessary to keep said lots, graves, and Yaults in proper and
attractive condition provided that no walls of cement or other material and no
vaults shall be built of cement or other material in such part of Iv? Green Cemetery
Perpetual Care No.2 as herein ~escribe~, the walls of which are above the surface
of the ground and no mon~unents or markers shall be placed thereon other than marble
or other indestructible material and all markers and all mon~ments shall be of
reasonable uniform size and character.
Section 5. The City of Bremerton shall provide a record for ali. lots sold in
the plat of Ivy Green Cemetery Perpetual Care No.~.
Section 6. The direct superv-~sion and care of Ivy Green Cemetery Perpetual
Care No.2 shall be tuader the supervision of such commissioners as the City Co~l~-
ission may direct an~ the good faith of the City of Bremerton is hereby pledged
forever and during its existence as a municipality either under its present name
or any such name as may hereafter be adopted for the perpetual care, upkeep, and
maintenance of all such lots provided for perpetual care except Block 1 thereof in
said Ivy Green Cemetery Perpetual Care No.2, according to the plat thereof.
