HomeMy WebLinkAbout1561 ORDINANCE NO. 1561 AN ORDINANCE amending Ordinance No. 1418, known as the Building Code of the City of bremerton, by adding thereto Chapter 50, Sections 1, 2 and 3; providing for the building, use and demolition of' temporary structures, and declaring an~ emergency. THE CITY OF BR~MER~ON DOES ORDAIN: Section 1. That Ordinance No. 1418, ~own as th8 Building Code of the City of Bremerton, be and the same is hereby amended, by adding thersto Chapter 50, Ssctions 1, 2 and $, as follows: CHAPTER 50. ?E~iPORARY B~U]LDINGS, STR~CTURES OR T~TS. Section 1. The City Pl~ning Co~nission, after public hearing, is hereby authorized and ~mpowered, upon the application being made in writing ther~- for, stating the purpose for which said buildin~ o~~ s tructur~ is to be used, and accompani~d by plans and sp~ciflcations showing in d~tail 5he con- struction of such building, stPucture or t~nt, and ~he means of exit there- from, ~d of s~i~ation and ~ire prot~ction to b~ provided th~rein~ to authorizs the Building Inspector to issu~ permits for the erectlcn~ use and occupancy of t~mporary wooden buildings, temts and other structures not more than one (1) story in height, to be used for the purpose of hold- ing religious services therein, convention halls, fair or expositlcn purposes ~d other public assemblages, or for stables, workshops, boarding houses or sleeping apartments used in connection with the grading of streets or other public works; to specify in detail how such building or other structure shall be erected, used and occupied; to provide that such build- ing or structure shall be demolished; and all material therein contained or used in connection therewith; and all debris resulting from such use, shall be removed from the premises where such building or structure is located within a time specified in such permit, which time shall o e not more ~han six (6) months from the granting of such pe~it; and to provide and specify the means of fire protection to be installed and maintained in connection with such building or structure, and the means for securing and maintaining sanitary conditions in connection therewith. Section 2. In the event that such permit for the erection of such temp- orary building or structure shall, be authorized by the ~lty Planning Co~lission, the applicant therefor shall file with the City Clerk a bond to the City of Bremerton with good and sufficient sureties, to be approved by the ~aayor and City Cl~rk, in a penal s~ to be fixed by the City Plann- ing Co~ission and conditioned that he will on or before the date set in such permit for the demolition and removal of such building or structure, and remove f~om the premises where the s~e is erected all material therein contained and used in connection therewith, and all debris resulting from the use thereof, place the said premises in a sanitary condition, ~d restore them, as near as may be, to the condition in which they existed prior to the erection of such building, structure or tent; ~d conditioned further, that in case the principal on said bond shall fail, refuse or neglect to comply with the conditions hereof and of the permit for the issuance of which such bond is executed, the Oity of Bremerton, by its duly authro~zed officers, may enter upon the premises and demolish said building or structure and remove the s~e and all materfal used in connec- tion therewith, and the cost and expense thereof may be recovered from the principal ~d sureties on said bond. Section ~. Nothing in this section contained shall be construed as requir- ing or directing the City Planing Co~ission to issue any permit for the erection of any temporary bui!ding~ structure, or tent, as in this section provided, but the City Planning Co~ission may in all cases refuse to issue or grnnt such permit, provided that no temporary building, structure or tent shall be permitted in a First, Second or Third Fire Zone. Section 2. That this ordinance is necessary for the preservationof the peace, health and safety of the City of Bremerton, and shall become effective i~ediately on passage and publication.
