A~: ORDINANCE providing for the improvement of Rainier Avenue between Ninth
Street and Eleventh Street by clearing, grubbing, grading for and cortstruction of
5 ft. concrete sidewalks, concret~ curbs and gutters, in accord~ce with the maps,
plans and specifications on fil~ in the oI~fic~ of the City Clerk, establishing an
improvement district, providing'for the levying of assessments for the pavement of
such improvement and making such i~provem~nt payable by bonds.
THE CITY OF
Seotion 1. That Rainier Avenue b~tw~en Ninth Street ~d Eleventh Street
b~ improved by clearing, grubbing, grading for and construction of 8 ft. concrete
simewalks, concret~ curbs and gutters, together with the doing of any and all other
work in co~ection therewith as may be necessary to make such inprovement a complet~
job~ all in accordance with maps, plans and specifications now on file in the offic~
of the City Clerk of the City of Bremerton.
Section ~. That the cost and expense of said improvement shall be borne
by ~d assessed against the property included in the assessment district hereinafter
created, in accordanc~ with the provisions of Section ~68 of Remi~gton~s Revised
Statutes, ~xc~pt such proportion of said cost as shall ~ borne by ~ua paid for by
~ither a department of th~ Stat~ of ~ashington or a d~partment of the national govern-
ment created for emergency relief, which proportion of such cost and expense is
h~r~by declared to b~ in accordancs with special benefits conferred upon such pro-
perty.
S~ction ~. There is hereby ~stablished and created a local improvement
district to be called and known as "Local Improvement District No. ~$," the bo~d-
aries of which district are described as follows: B~ginning at the intersection of
th~ c~nter lin~s of Ninth Street and Rainier Avenue; thenc~ W along th~ ce=t~r-line
of Ninth Street to the intersection of the center lines of Ninth Street and alley
on the W side of Block 1, Sunnysid~ Addition; th~nc~ N along the c~nter iin~ of said
alley to the center line of E!ev~nth Street; thenc~ E along the center line o~~ Ele-
venth street to a point midway b~tween Rainier avenu~ and Ol~pic avenue; thenc~ S
along ~a lin~ midway between ~d parallel to Rainier avenue ~d Olympic avenu~ to a
point ~ ft. S of the N margin of ~k~ all~y along S sid~ of block ~, S~nysid~ Ad-
dition; th~nc~ W along a line
the intersection of the center lines of Ninth Street and ~ainier avenue, the point
of b~ginning.
Section ~. That the co's't and expense of said improvement to be borne by
said improvement district ~d e~clus~ve of the port~on borne by ~ither the State of
Washington or the United States Department for ~nergency Relief, as in Section ~ of
this ordinanc~ provid~d~ shall b~ assessed against said property included in said
improvement district in proportion to said area, and in aocordanc~ with the provi-
sions of Section ~68 of R~mington's Revised Statutes of th~ State of ~ashington and
th~ remainder of ssid cost of the improvement to b~ paid for by arr~gement with
~ither a department of th~ Stat~ of ~Vashington or a d~partment of th~ United States
Go~r~nt, as hereinafter provided.
Section 8. Bonds bearing interest at the rat~ of not to exceed six per c~nt
p~r ann~a, payabl~ on or O~for~ ten years from th~ mat~ of issuance, shall be issued
in pa~ent of the cost an~ expense of said improvement assessed against the property
included in ~he district hereinabove Oescrib~d, which bonds shall be redeemed by a
collection of special assessments, levied ~d assessed against the property w~thin
said district, payable in equal a~mual installments~ with interest at the rate of
not to exceed 8~ p~r ann~ under the mod~ of pa~ent by bon~s as required by law and
th~ ordinances of the City of Br~merton. Th~s~ bonds shall be d~liver~d to th~ con-
tractor in th~ redemption of w~rrants on the local improvement district f~ms issued
on the estimate of ~h~ City Engineer, or th~ City of Br~m~rton may, at ~s option,
s~ll bonds either to th~ United Stat~s Government or to any privat~ person or persons~
~d make such redemption in cash.
Section 6. This ordinanc~ sha~l take effect i~diatety following its
passage and publicat~on, as provided by law.
PASSED by the City Council of the City of Bramerton, signed by th~ ?~ayor
and attested by the City Cl~rk in authentication thereof, this ~Oth day of J~me,
1947.
