Home My WebLink About1788 ORDINANCE NO. 1788~ AN ORDINANCE providing for the improvement of Callow Ave. between 9th St. and 15th St., Montgomery Ave. between 9th St. and~15th St., ~d Olympic Ave. between Burwell St. and 6th St. by clearing, grubbing, grading for and construction of 5 ft. concrete sidewalks, concrete curbs and gutters and pro- viding for drainage, all in accordance with the maps, plans and specifications on file in the office o~' the City Clerk, establishing an improvement district, providing for the levying of assessments for the payment of such improvement and making such improvement payable by bonds. THE CITY OF BRENERTON DOES ORDAIN: Section 1, That Callow Aveune between 9th St. and lSth St., Montgomery Ave. between 9th St. and 15th St., and Olympic Ave. between Burwell St. and 6th St. be improved by Clearing, grubbing, grading for and construction of 5 ft. concrete sidewalks, concrete curbs and gutters, and providing for drain- age, together with the doing of any and all other work in connection therewith as may be necessary to make such improvement a complete job, all in ac~rdance with the maps, plans and specifications now on file in the office of 'the City Clerk of the City of Bremerton. Section 2. That the cost and expense of said improvement shall be borne by and assessed against the property included in the assessment district here- inafter created~ in accordance with the provisions of Section 9Z~$ of Reming- ton's Revised Statutes, except such proportion of ssi8 cost as sh~llb e borne by and paid for by the State of Washington or other Government agency which proportion of such cost and expense is hereby declared to be in accordance wi~ special benefits conferred upon such property. Section 3. There is hereby established an~ created a local improvement district to be called and known as "Local Improvement District No. 2Z5", com- posed of $ units as hereafter designated, the boundaries of which district and units thereof are described as follows: Unit i - Beginning at the intersection of the center lines of Callow Ave. and Ninth Street; thence West along the Center line of Ninth Street to its in- tersection with the Center line of the alley in Block ~ Third Addition to Charleston; thence North along the Center line of said alley extended to a point 170 feet North of the center line of ~irteenth Street; thence East 1Z8 feet to the Center line of Callow Ave.; thence North along the center line of Callow Ave~162.7 feet~ thence West 1~6 Feet to a point midway between Callow and Wycoff Avenues.; thence North along a line midway between and parallel to Callow and Wycoff Aves., to the c~ter line of Fifteenth Street; thence East along the center line of Fifteenth Street to a point midway between Callow and ~ontgomery Avenues; thence South along a line midway betwen and parallel to Callow and Montgomery Avenues to the center line of Ninth Street; thence West along the center line of Ninth Street to its intersection with the center line of Callow Ave., to the point of beginning. Unit ll - Beginning at the intersection of the center lines of Montgomery Ave. and Ninth Street; thence West along the center line of Ninth Street to its intersection with the center line of the alley in Block ~3, Third Addition to Charleston; thence North along the center line of said alley extended to its intersection with the center line of Fifteenth Street; thence East along the center line of Fifteenth Street to its intersection with the center line of ~e alley midway between and parallel to ~ontgomery and Rainier Avenues; thence South along the center line of said alley to its intersection with the center line of Ninth Street; thence West along the center line of Ninth Street to its intersection with the center line of Montgomery Avenue, the point of beginning. Unit lll- Beginning at the intersection of the center lines of Olympic Ave. and Burwell Street; thence West along the center line of Burwell Street 62.5 feet; thence North along a line para%lel to Olympic Ave. 172 feet to the South line of Lot l, J.W. Bryan's Second Addition 2o Bremerton; thence West along the South line of said Lot i 56.55 feet to the Southwest corner of said Lot l; thence North along the West line of Lots I to 8 inclusive, J.W. Bryan'~ Second Addition to the Northwest corner of Lot 8, J.W. Bryan,s Second Addition; thence East along the North line of said Lot 8 49.5 feet to the Southwest Cor- ner of Lot 9, Block i Urban's Addition to Bremerton; ~ence North along the West line of said Lot 9, Block l, extended to its intersection with the center line of Sixth Street; thence East along the center line of Sixth Street to a point 45 feet East of the center line of Olympic Avenue; thence South and along the East line of Lot "D", Urban,s A~dition, to the North line of Lot 7, Block l, J.W. Section 4. That the cost and expense of said improvement to b e borne by said improvement district and exclusive of any portion borne by either the State of Washington or other government agency, shall be assess:ed against said proper- ty included in said improvement district in proportion to said area, except cert- ain units wherein the special benefits conferred upon the property are not fair- ly reflected by the use of the termini and ~ne method, the assessment shall be made against the property of the district or any oertain unit within the district in accordance with the special benefits it will derive from the improvement with- out regard to the zone and termini method, and in accordance with the provisions of Section 9365 of Remington,s Revised Statutes ot' the State of' Washington and the remainder of said cost oi' the improvement robe paid for by arrangement, if any, wi th the State of Washington or other government agency. Section 5. Bonds bearing interest at the rate of not to exceed six per cent per annum, payable on or before ten years from the date of issuance, shall be issued in payment oi' the cost expense of sai~ improvement assessed against the property included in the district hereinabove described, which bonds shall be re- deemed by a collection of special assessments levied and assessed against the property within sai~ district, payable in equal annual installments, with inter- est at the rate of not to exceed 8% per annum under th~mode of payment by bonds as required by law an~ the ordinances of the City of B?emerton. These bonds shal be delivered to the contractor in redemption of war~ants on the local improvement district funds issued on the estimate of the City Engineer, or the City of Brem- erton may, at its option, sell said bonds and n~ake such redemption in cash. Section 6. This ordinance shall take effect immediately following its pas- sage and publication, as provided by law.
